<br /> 3 <br />Regular Meeting May 29, 1984 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br /> WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br /> OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br /> 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF 0.38 <br /> ACRES IN THE LINDSEY AND HARVEY ADDITION, BEING BLOCK <br /> 7, LOT 3, A/K/A 456 LINDSEY STREET, FROM "R-l" <br /> (SINGLE-FAMILY DWELLING DISTRICT) TO liD" (MULTI- <br /> FAMILY DWELLING DISTRICT). <br />Mayor Craddock asked if anyone wished to speak in favor or in opposi- <br />tion to the zoning change, and no one did, so she closed the hearing. <br />Mr. Farr moved for approval and Mayor Craddock seconded the motion. <br />After a brief discussion Mr. Farr withdrew his motion and Mayor Crad- <br />dock withdrew her second. Mr. Coddington then moved to approve the <br />Ordinance on first reading to get it back on the table for discussion <br />and Mr. Guerra seconded the motion. Mr. Coddington stated the City <br />does need to address the drainage problems of the area and that it <br />was denying the owner of the property the opportunity to develop his <br />property. On roll call the Council unanimously voted denial of the <br />Ordinance. <br />Mayor Craddock opened a public hearing to consider approval of an <br />Ordinance on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br /> WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br /> OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER <br /> 29, 1980 (VOL. 54) BY CHANGING THE ZONING OF TWO <br /> TRACTS OF 5.280 ACRES BEING: TRACT ONE: 2.980 ACRES, <br /> MORE OR LESS, OF LAND AREA IN THE THOMAS H. W. FOR- <br /> SYTH SURVEY, HAYS COUNTY, TEXAS, BEING A PORTION OF <br /> THAT 23.92 ACRE TRACT DESCRIBED IN A DEED FROM L. <br /> SUMNER TOWNSEND, ET UX, TO WILLIAM A. WYATT DATED <br /> MAY 17, 1922 AND RECORDED IN VOLUME 83, PAGE 309 OF <br /> THE HAYS COUNTY DEED RECORDS AND TRACT TWO: 2.30 <br /> ACRES OF LAND AREA IN THE THOMAS H. W. FORSYTH SURVEY, <br /> HAYS COUNTY, TEXAS, BEING A PORTION OF THAT 23.92 ACRE <br /> TRACT DESCRIBED IN A DEED FROM L. SUMNER TOWNSEND, ET <br /> UX, TO WILLIAM A. WYATT DATED MAY 17, 1922 AND RECORDED <br /> IN VOLUME 83, PAGE 309 OF THE HAYS COUNTY DEED RECORDS <br /> A/K/A 1710 AND 1706 RANCH ROAD TWELVE, RESPECTIVELY, <br /> FROM "A-Oil (AGRICULTURAL-OPEN SPACE) TO "c" (COMMERCIAL <br /> DISTRICT). <br />Mayor Craddock asked if anyone wished to speak in favor of the zoning <br />request. Kevin Smith of Keys Builders addressed the Council advising <br />their company had shelfed their plans to build a multi-family project <br />and were now planning to construct a partial retail center which would <br />be in conformity with the Master Plan Land Use Map for this area. No <br />one else wished to speak in favor or in opposition to the zoning re- <br />quest, so Mayor Craddock closed the public hearing. City Attorney <br />Hankins noted our Ordinance reflected the request was from "AO" to <br />"c" and in some of the staff back-up information it reflected the <br />change was from "R-l" to "C". Mayor Craddock moved to table first <br />reading of the Ordinance until the June 11, 1984 Meeting for clari- <br />fication of this point and Mr. Coddington seconded the motion, which <br />passed unanimously. <br />
