<br />best judgment as a design professional familiar with the construction <br />industry. <br /> <br />3.1.2 <br /> <br />In providing opinions of cost, financial analyses, economic <br /> <br />feasibility projections, and schedules for the project, the Engineer <br />has no control over cost or price of labor and materials; unknown or <br /> <br />latent condi tions of existing equipment or structures that may affect <br /> <br />operation or maintenance costS¡ <br /> <br />competitive bidding procedures and <br /> <br />market conditions; time or quality of performance by third parties; <br />quali ty , type, management, or direction of operating personnel; and <br /> <br />other economic and operation factors that may materially affect the <br /> <br />ul timate proj ect cost or schedule. <br /> <br />Therefore, the Engineer makes no <br /> <br />warranty that the Owner's actual project costs, <br /> <br />financial aspects, <br /> <br />economic feasibility or schedules will not vary from the Engineer's <br /> <br />opinions, analyses, projections, or estimates. <br /> <br />When the Owner requires <br /> <br />the Engineer to prepare quantity and material take-offs and/or opinions <br />of cost from plans and specifications that are less than 100 percent <br /> <br />complete, the Owner will hold the Engineer harmless from any and all <br />loss, liability, or claims resulting from the incompleteness. <br /> <br />3.1.3 <br /> <br />A fixed limit of construction cost will be established for <br /> <br />this <br /> <br />project(s) . <br /> <br />The <br /> <br />Engineer <br /> <br />shall <br /> <br />be <br /> <br />permitted <br /> <br />to <br /> <br />include <br /> <br />contingencies for design, bidding and price escalation, to determine <br />what materials, equipment, component systems and types of construction <br /> <br />are to be included in the construction contract documents, <br /> <br />to . make <br /> <br />reasonable adjustments in the scope of the project(s) and to include in <br /> <br />the <br /> <br />construction <br /> <br />contract <br /> <br />documents <br /> <br />alternate bids <br /> <br />to <br /> <br />adjust <br /> <br />the <br /> <br />construction cost to the fixed limit. <br /> <br />The fixed limit of construction <br /> <br />-15- <br />
