On roll call the following vote was <br /> recorded: <br /> AYE: Brown, Coddington, Farr, Kissler, Moore. <br /> NAY: None. <br /> ABSTAIN: Guerra. <br /> Mr. Farr introduced for consideration approval of an Ordinance on <br /> first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING SECTION 23-1 OF ARTICLE I OF <br /> CHAPTER 23 OF THE CODE OF ORDINANCES OF SAID CITY <br /> AND ADDING A SECTION 23-3 TO SAID ARTICLE OF SAID <br /> CHAPTER OF SAID CODE TO DESIGNATE THOSE RESPONSIBLE <br /> FOR THE PLACEMENT OF NOTICES ON UTILITY POLES AND <br /> ESTABLISHING A PENALTY FOR VIOLATIONS AND DECLARING <br /> AN EFFECTIVE DATE. <br /> Mr. Guerra moved for approval of the Ordinance on first reading and <br /> Mr. Brown seconded the motion. Mr. Coddington moved to amend the <br /> Ordinance in Section 23-1. Placement of advertisements, handbills, <br /> etc. on utility poles -- Prohibited, to read as follows: <br /> "No person shall, either directly or indirectly, cause <br /> or authorize to be posted, nailed, pasted or otherwise <br /> attached or affixed to any telephone pole, electric <br /> pole or any other public utility pole located within <br /> the corporate limits of the city any advertisement, <br /> handbill, circular, poster or piece of paper. The <br /> primary beneficiary of any advertisement, handbill, <br /> circular, poster or piece of paper posted, nailed, <br /> pasted or otherwise attached or affixed to any tele- <br /> phone, electric or any other public utility pole 10- <br /> cated within the corporate limits of the city shall be <br /> presumed to have authorized or caused, either directly <br /> or indirectly, the placement thereof. As used in this <br /> ordinance, 'person' shall mean any individual, associa- <br /> tion, firm, corporation, partnership or organization." <br /> Ms. Kissler seconded the motion. The above amendment was read in its <br /> entirety into the record. The Council voted unanimously for approval <br /> of the amendment, then voted unanimous approval of the Ordinance on <br /> first reading. <br /> Mr. Farr introduced for consideration approval of an Ordinance on first <br /> reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING CHAPTER 2, ARTICLE VII, SEC- <br /> TION 2-125 OF THE CODE OF ORDINANCES OF SAID CITY TO <br /> PROVIDE A DEFINITION OF THE WORD "CITIZENS OF THE CITY <br /> OF SAN MARCOS"; AND DECLARING AN EFFECTIVE DATE. <br /> Ms. Kissler moved to approve the Ordinance on first reading and Mr. <br /> Guerra seconded the motion. During discussion Mr. Farr and Mr. Cod- <br /> dington felt it would be better to limit the number of positions who <br /> can be non-residents of the City rather than allowing all members of <br /> the Commission to be non-residents.
