<br />4. <br /> <br />At the expiration of the term of this Lease, <br /> <br />Lessee shall <br /> <br />forthwith remove all of its property and equipment and all trash and junk <br /> <br />which may have accumulated on the premises, and deliver the said premises <br /> <br />to Lessor in good order and condition. <br /> <br />5. <br /> <br />Lessor shall not be liable to Lessee, or to Lessee I s agents, <br /> <br />employees, representatives, invitees or licensees, or to trespassers, for <br /> <br />any damage to person or property caused by the negligence of any other <br /> <br />tenant, or due to the building and other improvements on said premises or <br /> <br />any appurtenances <br /> <br />thereof being <br /> <br />improperly <br /> <br />constructed, <br /> <br />or being <br /> <br />or <br /> <br />becoming out of repair, nor for any damage from any defect or want of <br /> <br />repair of any part of the improvements on said premises, <br /> <br />but Lessee <br /> <br />accepts and will accept said premises as suitable for the purposes for <br /> <br />which the same ar leased, and waives any defect therein, and agrees to <br /> <br />indemnify and hold Lessor harmless from all claims for such damage. <br /> <br />6. <br /> <br />Lessee shall promptly pay all utility charges pertaining to its <br /> <br />use of the leased premises. <br /> <br />Lessee shall comply with all ordinances and <br /> <br />laws applicable to said premises and àll orders and requirements for the <br /> <br />corrections, prevention and abatement of nuisance on or connected with <br /> <br />said premises during the term of this Lease. <br /> <br />7. <br /> <br />It is agreed and understood that any holding over by Lessee of <br /> <br />the hereby leased premises, <br /> <br />after the expiration of this lease, <br /> <br />shall <br /> <br />operate and be construed as a tenancy from month to month. <br /> <br />8. <br /> <br />It is further agreed and understood that Lessor, its agents, <br /> <br />successors and assigns, <br /> <br />shall have the right to enter upon the leased <br /> <br />premises and leave same, with or without the permission of or any notice <br /> <br />to Lessee, at all reasonable times, for the purpose of inspecting said <br />premises and the improvements thereon. <br /> <br />9. <br /> <br />This Lease is subordinate and subject to the terms, conditions, <br /> <br />reservations and restrictions of an "Indenturen dated February 14, 1966, <br /> <br />as recorded in Volume 313, <br /> <br />Page 463 of the Deed Records of Caldwell <br /> <br />County, <br /> <br />Texas, <br /> <br />by which the City of San Marcos holds title to said <br /> <br />Airport property. <br /> <br />10. <br /> <br />The Lessee, <br /> <br />in exercising any of the rights <br /> <br />or privileges <br /> <br />herein granted to him, <br /> <br />shall not on the grounds <br /> <br />of <br /> <br />race, <br /> <br />color or <br /> <br />national origin <br /> <br />discriminate <br /> <br />or <br /> <br />permit <br /> <br />discrimination <br /> <br />against <br /> <br />any <br /> <br />-3- <br />
