<br />Disaster Contingency Fund. The Merit System does not apply to the temporary <br />positions. The Governor may allocate funds appropriated under this Act to <br />implement the purposes of this Act. <br />(i) Nothing in this Act may be construed to limit the Governor1s authority <br />to apply for, administer, or expend any grant, gift, or payment in aid of <br />disaster prevention, preparedness, response, or recovery. <br />(j) No debris or wreckage from public or private property may be removed <br />until the affected local government, corporation, organization, or individual <br />presents an unconditional authorization for removal to the Governor. No debris <br />or wreckage may be removed from private property until the state is 1nd.:;mi~ified <br />iigé!Ïnst. an,y claim arising from removal. Whenever the Governor provide!: ÙH <br />clearance of debris or wreckage under the provisions of this Act, state <br />employees or other individuals acting by authority of the Governor may enter on <br />private land or water to perform tasks necessary to the removal or clearance <br />operation. Except in cases of willful misconduct, gross negligence, or bad <br />faith, a state employee or agent performing his duties while complying with <br />orders of the Governor issued under the provisions of this Act shall not be <br />liable for the death of or injury to persons or damage to property. <br />(k) Any political subdivision of this state is expressly authorized to <br />acquire, temporarily or permanently, by purchase, lease, or otherwise, sites <br />required for installation of temporary housing units for disaster victims and <br />to enter into whatever arrangements (including purchase of temporary housing <br />units and payment of transportation charges) which are necessary to prepare or <br />equip the sites to utilize the housing units. <br /> <br />[ <br /> <br />State Di vi s i on of Eme rgency Management <br /> <br />Section 6.[ (a) A Division of Emergency Management is established in the office <br />of the Governor. The Division shall have a Director and a State Coordinator. The <br />Director shall be appointed by and serve at the pleasure of the Governor. The <br />Coordinator shall be appointed by the Director. The Division shall have other <br />coordinating and planning officers and other professional, technical, secre- <br />tarial, and clerical employees necessary for the performance of its functions: <br />[ (b) The Division shall prepare and maintain a comprehensive state emergency <br />management plan and keep it current. The plan may include: <br />(1) provisions for prevention and minimization of injury and damage caused <br />by disaster; <br />(2) provisions for prompt and effective response to disaster; <br />(3) provisions for emergency relief; <br />(4) provisions for energy emergencies; <br />(5) identification of areas particularly vulnerable to disasters; <br />(6) recommendations for zoni n9, buil di ng ,and other land-use controls, <br />safety measures for securing mobile homes or other nonpermanent or semipermanent <br />structures, and other preventive and preparedness measures designed to eliminate <br />or reduce disasters or their impact; <br />[ (7) provisions for assistance to local officials in designing local <br />emergency management plans; <br />(8) authorization and procedure.s for the erection or other construction of <br />temporary works designed to protect aga.inst or mitigate danger~ damage, or loss <br />from flood, conflagration, or other disaster; <br />(9) preparation and distribution to the appropriate state and local offi- <br />cials of state catalogs of federal, state, and private assistance programs; <br />(10) organization of manpower and channels of assistance; <br />(11) coordination of federal, state, and local emergency management <br /> <br />[ <br /> <br />[ <br /> <br />Attachment 2 <br />Tab 1 <br />Page 5 <br />
