<br />I <br /> <br />I <br /> <br />I <br /> <br />A. <br /> <br />No fencing shall be placed along a adiacent property line with <br />segments that are not in conformance with subsection (a) of this <br />section. <br /> <br />B No fencing shall be located in a manner to preclude landscape <br />maintenance or fence repair without a suitable access agreement. <br /> <br />C. No fencing above three feet in height shall be located closer than <br />the building setback line adiacent to single family residential uses. <br /> <br />D. No chainlink or wire fencing shall be located closer than the <br />building setback line adiacent to single family or multiple-family <br />residential uses. <br /> <br />(3) Heif!ht of Fences. All fences or walls located along adiacent property <br />lines shall be no taller than eight feet at the building setback line or six <br />feet if located closer unless the following conditions are met: <br /> <br />A. A ioint fencing application is made with the signature of both <br />adiacent property owners; and <br /> <br />B. The Planning Director considers the desired fence to protect the <br />interests of adiacent property owners and the community at large. <br /> <br />(c) <br /> <br />Barbed wire, razor wire or similar security fencing features are prohibited unless <br />approved under subsection (b )(3) of this section. <br /> <br />(d) Above-ground electrical fencing (does not include underground "virtual fencing," <br />which is allowed), wire mesh (such as hog wire, chicken wire) and barbed wire <br />are prohibited as perimeter fencing except on undeveloped parcels of five acres or <br />greater in size, or platted lots with a recognized agricultural tax exemption. <br /> <br />Ce) Gates for Vehicular Access. Gates designed for vehicular access shall be set back <br />from the property line a minimum of 24 feet and shall meet all requirements of <br />the fire code. <br /> <br />Cf) Permit Required. It is unlawful to construct a fence without first applying for and <br />obtaining a permit. <br /> <br />(g) Fences within Public Easements. Fences within public easements shall have a <br />gate or removable panel to allow for maintenance access to the easement area. <br /> <br />(h) <br /> <br />Fences within Drainage Easements. Fences within drainage easements shall be <br />constructed in a manner to not restrict the flow of drainage water. <br /> <br />Page 29 of 50 <br />
