<br />I <br /> <br />I <br /> <br />I <br /> <br />Development Plat approval, unless extended in accordance with Article 3, Division 5 of <br />this Chapter 1, shall expire and the applicable plat shall be deemed null and void. <br /> <br />SECTION 12. Section 1.6.6.1(h)(2) of the City Land Development Code is amended as <br />follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Section 1.6.6.1 <br /> <br />Construction Plans <br /> <br />(h) Criteria for Approval. The Engineering Director or the Commission on appeal <br />shall render a decision on the construction plans in accordance with the following <br />criteria: <br /> <br />(2) The plans conform to the approved Watershed Protection Plan (Phase 2) <br />and Site Preparation Permit; <br /> <br />SECTION 13. Section 1.6.6.3(a)(2) of the City Land Development Code is amended as <br />follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Section 1.6.6.3 <br /> <br />Subdivision Improvement Agreement <br /> <br />(a) <br /> <br />Obligations under Agreement. Whenever public improvements to serve the <br />development are deferred until after Final Subdivision Plat or Final Development <br />Plat approval, the property owner shall enter into a subdivision improvement <br />agreement by which the owner covenants to complete all required public <br />improvements, including residential lot improvements for drainage or erosion <br />control, and common area improvements, no later than two years following the <br />date upon which the Final Subdivision Plat or Final Development Plat is <br />approved. The agreement shall be subject to review and approval by the City <br />Attorney, and shall be approved by the Planning and Zoning Commission with <br />approval of the Final Subdivision Plat or Final Development Plat. The agreement <br />shall contain the following provisions: <br /> <br />(2) Covenants to warranty the improvements for a period of twe one years <br />following acceptance by the City; <br /> <br />SECTION 14. Section 1.6.8.4(b)(12), (c), (e) and (f) ofthe City Land Development Code <br />are amended as follows (underlining indicates added text; o';erstrike indicates deleted text): <br /> <br />Section 1.6.8.4 <br /> <br />Amending Plats <br /> <br />(b) Applicability. The procedures for amending plats shall apply only if the sole <br />purpose of the amending plat is to: <br /> <br />(12) Allow for modification, abandonment or addition of an easement with the <br />written consent of entities to which the easement is dedicated. <br /> <br />Page 7 of 50 <br />
