<br />(c) <br /> <br />Effect. Upon approval by the Planning and Zoning Commission Director, an <br />amending plat may be recorded and is controlling over the recorded plat without <br />vacation of that plat. <br /> <br />I <br /> <br />(e) Decision. The Planning and Zoning Commission Director shall either approve, <br />approve with conditions, or deny the application for an amending plat. <br /> <br />(f) Criteria for Approval. The Planning and Zoning Commission Director shall <br />decide whether to approve, conditionally approve or deny the amending plat <br />application based upon the following criteria: <br /> <br />SECTION 15. Section 1.7.1.2(a)(1) and (b) of the City Land Development Code are <br />amended as follows (underlining indicates added text; o','erstrike indicates deleted text): <br /> <br />Section 1.7.1.2 <br /> <br />Sequence of Approvals <br /> <br />(a) Phased Plans. An application for a Watershed Protection Plan typically shall be <br />prepared and acted upon by the City in two phases. <br /> <br />(1) A Watershed Protection Plan (Phase I) shall be prepared prior to approval <br />of the following types of development applications: <br /> <br />a. Utility Extension, I <br />b. Development Transfer Petition, <br />c. Certificate of i^...ppropriateness, <br />ca. Subdivision Concept Plat, <br />de. Preliminary Subdivision Plat, <br />ef. Preliminary Development Plat, or <br />fg. Cluster Development Plan. <br /> <br />(b) Prior Approvals. An application for a Watershed Protection Plan (either phase), <br />shall not be approved until all petitions for legislative decisions authorizing the <br />use of or provisions of services to the property have been approved and remain in <br />effect for land to be subject to the Watershed Protection Plan (either phase). An <br />application for a Phase 2 Watershed Protection Plan shall not be approved or <br />approved with conditions prior to formal acceptance by FEMA of any required <br />Conditional Letter of Map Revision. <br /> <br />I <br /> <br />SECTION 16.
