<br />Chapter 1 Development Procedures - Article 6 Platting Procedures <br /> <br />(8) Where the proposed development is located in whole or in part in the <br />extraterritorial jurisdiction of the City and is subject to an interlocal agreement <br />under Tex. Loc. Gov't Code ch. 242, the proposed Subdivision Concept Plat <br />meets any county standards to be applied under the agreement. <br /> <br />(b) Conditions. In addition to any other conditions required to conform the plat to the <br />standards of this Land Development Code, the Planning and Zoning Commission may <br />condition approval on exclusion of land from the Subdivision Concept Plat or <br />adjustments in the proposed sequence or timing in the proposed phases of the <br />development. <br /> <br />Section 1.6.2.6 <br /> <br />Expiration and Extension <br /> <br />(a) Time of Expiration. Expiration of the Subdivision Concept Plat shall be governed by <br />the schedule of development approved by the Planning and Zoning Commission. The <br />subdivider shall submit and receive approval for a Preliminary Subdivision Plat or <br />Preliminary Development Plat for the first and all subsequent phases of the <br />Subdivision Concept Plat within the time limits prescribed in the approved phasing <br />schedule. Failure to meet a platting deadline included in the phasing schedule shall <br />result in the expiration of the Subdivision Concept Plat for that and all subsequent <br />phases of the subdivision. Expiration of the Preliminary Subdivision Plat, <br />Preliminary Development Plat, Final Subdivision Plat, or Final Development Plat for <br />any phase of the Subdivision Concept Plat shall result in the expiration of the <br />Subdivision Concept Plat for all phases for which any type of preliminary plat has not <br />been approved. <br /> <br />(b) Extension. The expiration date for any phase of the development may be extended by <br />the Planning and Zoning Commission under Section 1.3.5.1. Extension of the <br />expiration date for the phase extends the expiration date for the Subdivision Concept <br />Plat for a like period. A Subdivision Concept Plat is not subject to reinstatement <br />following expiration. <br /> <br />Section 1.6.2.7 <br /> <br />Remainder Tracts <br /> <br />(a) A remainder tract is that portion of a larger parcel that is not included within the <br />boundaries of a subdivision plat. Remainder tracts shall not be considered lots or <br />tracts of the subdivision. Approval of a subdivision plat shall not constitute approval <br />of development on a remainder tract. <br /> <br />(b) Information accompanying a subdivision plat application for remainder tracts shall be <br />deemed to be an aid to the Planning and Zoning Commission in taking action on the <br />plat application and may be used to determine whether development of the land <br />subject to the plat will be adequately served by public facilities and services and is <br />otherwise in compliance with this Land Development Code, taking into account the <br /> <br />City of San Marcos, Texas <br /> <br />1-96 <br /> <br />Land Development Code - Final <br /> <br />It <br /> <br />It <br /> <br />, <br />
