<br />-- <br /> <br />41 <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 9 Construction Permits <br /> <br />ARTICLE 9: <br />CONSTRUCTION PERMITS <br /> <br />Division 1: General Provisions <br /> <br />Section 1.9.1.1 <br /> <br />Terminology and Effect <br /> <br />(a) Scope of Term. For purposes of this Chapter I, the term "construction permit" refers <br />to any authorization to construct, alter or place a structure on a lot, tract or parcel. <br />The term excludes an authorization to construct a capital improvement to be <br />dedicated to the public in support of a proposed land use, the grading of land, the <br />removal of vegetation, and other activities authorized to prepare a development site <br />for construction of a structure. <br /> <br />(b) Effect. Approval of a construction permit authorizes the property owner to place or <br />construct the structure on the lot, tract or parcel in accordance with the terms of the <br />permit. Approval of a construction permit confirms that the application conforms to <br />all requirements of this Land Development Code pertaining to the construction of the <br />proposed structure. <br /> <br />Section 1.9.1.2 <br /> <br />Sequence of Approvals <br /> <br />(a) Prior Approvals. An application for a construction permit shall not be approved until <br />the following petitions or development applications, where applicable, have been <br />approved and remain in effect for land for which the application is made: <br /> <br />(1) All legislative applications needed to authorize the proposed uses for the land; <br /> <br />(2) All quasi-judicial applications; <br /> <br />(3) A Final Subdivision Plat or Final Development Plat; <br /> <br />(4) A Site Preparation Permit; and <br /> <br />(5) Any variance petition required for placement or construction of the structure <br />on the lot, tract or parcel. <br /> <br />(b) Accompanying Applications.
