It is mutually understood and agreed that the City will pro- <br />vide at its own expense, or arrange for LCRA to provide at no expense to <br />the Engineers: <br />1. All maps, plans, records, statistical and financial data, reports by <br /> others, explanations, etc., which are related to the electric distri- <br /> bution system and deemed useful in the work involved. <br />2. The major capital improvement program of LCRA for the electric distri- <br /> bution system for a 5 year projection period; including descriptions <br /> of the projects, their estimated cost, and probable time of expendi- <br /> ture. <br />3. A breakdown of actual historical operation and maintenance expense and <br /> capital expenditure data by major categories and projected operating <br /> costs of utility facilities to the extent available. <br />4. Other pertinent data as may be requested by the Engineers to the <br /> extent it is readily available or may be readily summarized. <br />SECTION IV - MISCELLANEOUS <br />1. Engineers shall be deemed to be an independent contractor. Engineers <br /> will be permitted to engage in the performance of any other business <br /> or services which do not conflict with the furnishing of engineering <br /> services to the City. <br />2. The failure of either part to insist in anyone or more instances upon <br /> performance of any terms or conditions of this Contract shall not be <br /> construed a waiver of future performance of any such term, covenant or <br /> condition, but the obligations of either party with respect thereto <br /> shall continue in full force and effect. <br />3.
