It is mutually understood and agreed that the City will pro- vide at its own expense, or arrange for LCRA to provide at no expense to the Engineers: 1. All maps, plans, records, statistical and financial data, reports by others, explanations, etc., which are related to the electric distri- bution system and deemed useful in the work involved. 2. The major capital improvement program of LCRA for the electric distri- bution system for a 5 year projection period; including descriptions of the projects, their estimated cost, and probable time of expendi- ture. 3. A breakdown of actual historical operation and maintenance expense and capital expenditure data by major categories and projected operating costs of utility facilities to the extent available. 4. Other pertinent data as may be requested by the Engineers to the extent it is readily available or may be readily summarized. SECTION IV - MISCELLANEOUS 1. Engineers shall be deemed to be an independent contractor. Engineers will be permitted to engage in the performance of any other business or services which do not conflict with the furnishing of engineering services to the City. 2. The failure of either part to insist in anyone or more instances upon performance of any terms or conditions of this Contract shall not be construed a waiver of future performance of any such term, covenant or condition, but the obligations of either party with respect thereto shall continue in full force and effect. 3.
