<br /> -2- <br /> ARTICLE 2 <br /> EMPLOYMENT OF THE CONSULTANT <br /> 2.1 The OWNER agrees to retain the CONSULTANT, and the CONSULTANT <br /> agrees to perform the professional consulting serv ice s in connection <br /> with the PROJEC'l' as set forth in sections following, and th e OWNER <br /> agrees to pay: and the CONSULTANT agrees to accept fees as specified in <br /> sections followlng as full and final compensation for the work <br /> accomplished. <br /> 2.2 The parties hereto agree and understand that OWNER is relYlng <br /> upon CONSULTANT as an expert in the fields of airport runway overlay <br /> design and construction. CONSULTANT shall be responsible for the <br /> proper, accurate and adequate design of the PROJECT as well as the <br /> preparation of accurate and adequate plans, specifications, reports and <br /> other Contract Documents for the PROJECT, notwithstanding provisions in <br /> this AGREEMENT pertaining to OWNER's review, approval and/or acceptance <br /> of reports, plans, specifications, Contract Documents, or other written <br /> materials prepared by CONSULTANT or its consultants, contractors, and <br /> subcontractors in connection with this PROJECT. <br /> 2.3 All consulting serv lces in connection with this contract <br /> shall be performed by the CONSULTANT in accordance with the standard of <br /> care exhibited by Consultants who possess special expertise in the type <br /> of work involved in this project. <br /> .ARTICLE 3 <br /> CONSULTANT SERVICES <br /> 3.1 BASIC SERVICES <br /> 3.1.1 The CONSULTANT agrees to perform professional services <br /> in connection with the PROJECT as hereinafter stated, including the <br /> stipulations within this AGREEMENT. Improvements for which <br /> professional serv ices will be furnished under this AGREEMENT shall be <br /> limited to the following items unless expanded in the manner set forth <br /> in Article 3: <br /> -- Reconstruction of Runway 12-30 and all related work. <br /> 3.1.2 The CONSULTANT shall render services necessary for <br /> development of the PROJECT into three phases as follows: <br /> PHASE 1 - preliminary design, preparation of cost estimates, <br /> and coordination with the Federal Aviation <br /> Administration~ <br /> PHASE 2 - Final design and preparation of detailed <br /> construction drawings and specifications: and <br /> PHASE 3 - General administration of construction and, if <br /> required by the OWNER, full-time construction <br /> inspection. <br />
