Edward Gary Drive, San <br /> Marcos, Texas, from the Zoning Commission's decision of May 6, <br /> 1986 to deny the restaurant of a Specific Use Permit to serve on- <br /> premise beer and wine. Mayor Younger declared the public hearing <br /> open. Mr. Willie Gonzalez approached the podeum. He read his <br /> appeal letter into the record. He stated that he is in total <br /> compliance and has met all standards to conduct his business <br /> according to the City Code. No one wished to speak in favor or <br /> against the appeal. Mayor Younger declared the public hearing <br /> closed. Mr. Coddington moved to grant the appeal and Mr. Guerra <br /> seconded the motion which passed unanimously. <br /> Mayor Younger introduced for consideration a public hearing and <br /> approval of Ordinance on first reading. The caption which was <br /> read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE <br /> OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING DE- <br /> FINITIONS FOR GROUP HOME, NONCONFORMING LOT, RESI- <br /> DENTIAL CARE FACILITY: BY ADDING GROUP HOME AS A <br /> PERMITTED USE IN ALL RESIDENTIAL DISTRICTS IN CON- <br /> FORMANCE WITH STATE LAW: BY ADDING RESIDENTIAL CARE <br /> FACILITY AS A SPECIFIC USE IN PARTICULAR DISTRICTS: <br /> BY PROVIDING SUPPLEMENTAL AREA REQUIREMENTS: BY PRO- <br /> VIDING REGULATIONS FOR NONCONFORMING LOTS: BY RE- <br /> DEFINING THE POWERS OF THE BOARD OF ADJUSTMENTS: AND <br /> DECLARING AN EFFECTIVE DATE. <br /> Mayor Younger declared the public hearing open. Shirley Wicker- <br /> sham approached the podeum. She asked what the powers of the <br /> Board were. Mr. Farr stated that the Board had the power to <br /> judge the size of the lots. Mr. Coddington requested that the <br /> Ordinance be written in language that a layman could understand. <br /> He directed that the City Attorney provide the Ordinance with the <br /> changes in it to discuss at the Council/Staff Retreat. Mayor <br /> Younger asked if anyone wished to speak in favor or against the <br /> Ordinance. No one did. Mayor Younger declared the public hearing <br /> closed. Mr. Farr moved to approve the Ordinance on first reading <br /> and Ms. Kissler seconded the motion.
