<br /> 5 <br /> Regular Meeting July 28, 1986 Page 3 <br /> Mayor Younger introduced for consideration a public hearing on the <br /> appeal of William C. Potter, Francis M. Rich, Jr., Alfred B. Sullivan <br /> and Daniel E. Farlow from the Planning Commission's decision of May <br /> 27, 1986 approving the final plat for Hughson Heights III. Mayor <br /> Younger opened the public hearing. Jim Nias, who i& an attorney re- <br /> presenting the appellants, stated the Master Plan calls for traffic <br /> to be routed somewhere other than through neighborhoods. He stated <br /> a culdesac could have alleviated some of the traffic that will be <br /> created by the plat. He stated it will cause a dangerous traffic <br /> situation and that the neighborhood is hoping that the Council will <br /> provide assistance to them in this matter. Mr. Hankins stated State <br /> Law will allow for Planning Commission approval on plats, then Council <br /> approval on plats, but our Ordinance does not provide for this process. <br /> Mr. Hankins stated the Council can discuss and make their views known to <br /> the Planning Commission for their future reference and if the Council <br /> finds illegalities in the Planning Commission's actions, then the <br /> Council could direct suit be filed to vacate the plat. William <br /> Potter stated he lives on LBJ and that he has difficulty in getting <br /> out of his driveway because there is brush on both sides of the road- <br /> way. He said if LBJ is going to be opened up to this new project, <br /> then improvements need to be made and that this development should <br /> not be allowed to open up this roadway until the improvements are <br /> made. He said the Master Plan called for the roadway to be four <br /> lanes in the future. Bob Shearer read into the record a letter set- <br /> ting forth he felt the Planning Commission had violated their oaths <br /> of office by approving this plat when the Master Plan has called for <br /> road infrastructure to occur in this area. Mr. Robbins stated that <br /> when infrastructure is not in place as called for in the Master Plan, <br /> that zoning should not be approved. He stated the bui1dout of this <br /> subdivision would take years and that he did not foresee any signifi- <br /> cant adverse impact occurring. He felt four lan~were not needed during <br /> the first part of this development being completed but that the City <br /> needs to acquire right-of-way and build the four lanes called for in <br /> the Master Plan within two years. Billy Moore, Chairman of the Plan- <br /> ning Commission, stated it was the opinion of the Planning Commission <br /> all requirements for platting had been met. Ms. Kissler stated it is <br /> time for the Council to take action to get the needed infrastructure <br /> in place. She stated she knew all the money needed was not in place <br /> and that it may take another bond package to get some of the infrastruc- <br /> ture in place. Jane Wilson stated that the Planning Commission's actions <br /> do not have to be approved by the Council and she would like to see the <br /> Council change that process so that the neighborhoods would have an <br /> appeals process to the Council. No one else wished to speak, so Mayor <br /> Younger closed the public hearing. Mr. Nicola moved consideration be <br /> tabled until after Executive Session and Ms. Kissler seconded the motion. <br /> On roll call the following vote was recorded: <br /> AYE: Brown, Coddington, Farr, Younger, Kissler, Nicola. <br /> NAY; Guerra. <br /> ABSTAIN: None. <br /> Mayor Younger introduced for consideration adoption of an Ordinance on <br /> emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTION 2-31 OF THE SAN MARCOS <br /> CODE OF ORDINANCES TO ADD A SERGEANT POSITION TO THE <br /> SAN MARCOS POLICE DEPARTMENT, AND DECLARING AN EMERGENCY. <br />
