<br />( 6 ) <br /> <br />( 7 ) <br /> <br />(8 ) <br /> <br />the person a reasonable opportunity to present evidence to <br />the Director that he or she is in compliance with this <br />Ordinance. If the person does not present evidence, the <br />Director shall order disconnection of the water and/or <br />sewage service line after giving at least 24- hours prior <br />notice. No public sewer connection or water connection <br />disconnected shall be reconnected until the condition <br />causing the disconnection has been corrected, and the <br />correction is of a permanent nature. <br /> <br />Measurement of Flow. The volume of flow used in computing <br />surcharges shall be based upon the average of actual water <br />usage for December, January, and February billing periods <br />or the actual consumption, whichever is less. <br /> <br />If a person has a substantial portion of the metered water <br />that does not reach the sanitary sewer system, she/he may, <br />at owner's expense and with the approval of the Director <br />install a separate City of San Marcos water meter at the <br />property line to measure the actual flow into the sanitary <br />sewer. If the actual flow to the sanitary sewer is <br />measured, the equipment used for measuring the flow, the <br />flow reporting procedure and the billing procedures used <br />shall be determined by a separate contractual agreement <br />between the owner and the City of San Marcos. <br /> <br />If the owner requests all wastewater charges be computed <br />using the actual measured volume discharged to the sanitary <br />sewer, the Utility Office shall be involved in any and all <br />contracts with the owner. <br /> <br />Determining the character and concentration of industrial <br />waste. The industrial waste discharged or deposited into a <br />sanitary sewer shall be subject to periodic inspection and <br />sampling as often as may be deemed necessary by the <br />Director. Samples shall be collected in such manner as to <br />be representative of the character and concentration of the <br />waste under operational conditions. The laboratory methods <br />used in the examination of the samples shall be those set <br />forth in the approved methods. The sampling schedule or <br />program for determining the character and concentration of <br />industrial waste shall be made by the Director at such times <br />and on such basis as he or she may reasonably establish. <br />Should the owner or occupant discharging industrial waste to <br />a sanitary sewer desire that a determination of the quality <br />of the industrial waste be made at some time other than that <br />scheduled by the Director, a special determination may be <br />made by the Director at the expense of the owner or occupant <br />discharging the waste. Anyone found to have a discharge in <br />violation of any part of this Ordinance may be charged a fee <br />to cover the sampling and laboratory testing of all samples <br />taken until the discharge is brought into compliance. <br /> <br />Self Monitoring. Industries that have National Pretreatment <br />Requirements promulgated by EPA shall follow the self- <br />monitoring and reporting requirements published in the <br />Federal Register. Any major wastewater discharger that <br />discharges wastes to the sanitary sewer system of the City <br />of San Marcos that is regulated by this Ordinance may, at <br />either their option or the Director's option take periodic <br />samples, analyze the samples for the presence and/or <br />quantity of pollutants listed in this Ordinance and report <br />the results to the Director. The frequency and methods of <br />sampling and analysis shall be congruent with approved <br />methods. Self-monitoring shall not replace the regular <br />sampling and testing routine of the City of San Marcos. <br /> <br />If a violation of this ordinance has bewen shown to exist <br />then the Director may require, for a period of three months <br />after conditions causing the violation have been corrected, <br />self-monitoring for those parameters of the industrial waste <br />causing the violation to have existed. <br /> <br />-13- <br />
