<br />NON-COMPLIANCE INVESTIGATION <br /> <br />The Director shall monitor industrial wastes discharged into the <br />sanitary sewer to ensure their quality meets the requirements of the <br />Ordinance including the National Pretreatment Standards. <br /> <br />The Director shall review Industrial Waste Discharge Permit <br />applications and self-monitoring reports, and shall collect samples <br />and analyze them to ensure industrial waste discharges are not <br />exceeding the quality limits established in the Ordinance. The <br />frequency of self reporting and the frequency of samples taken by the <br />City shall be established by the Director. Anyone found discharging <br />or depositing an industrial waste into the sewer that is not in <br />compliance with the limits of the Ordinance may be charged an <br />additional fee to cover the sampling and testing costs incurred by the <br />City. The Director may collect as many samples as is deemed necessary <br />to ensure a discharge has been returned to compliance. <br /> <br />If a discharge is found in violation of the Ordinance and the <br />discharges was not accidental as defined in Section 30-64 (10) of the <br />Industrial Waste Ordinance the Director may immediately discontinue <br />utility service to the discharger provided: <br /> <br />1. <br />2. <br /> <br />The discharge will disrupt the treatment process and may <br />cause the City to violate the NPDES permit, or, <br />CaU3ß enough damage to the collection system that it will <br />not function as designed or, <br />Cause a threat to public health by passing into a receiving <br />stream untreated. <br /> <br />3. <br /> <br />If the discharge is found in violation of the Ordinance, but is <br />not an emergency then the Director shall establish a compliance <br />schedule for the discharger as to when the illegal discharge will <br />cease. The Director may accept a compliance schedule from the <br />discharger in lieu of deriving one for him. If a discharger does not <br />meet the compliance schedule established by the Director, the Director <br />may terminate utility service to the discharger pursuant to <br />Section 30-64 (5) of the Industrial Waste Ordinance. <br /> <br />-66- <br />
