<br />UNACCEPTABLE CLIENTS <br /> <br />Legal Aid will not be required to provide legal assistance, regardless of <br />financial eligibility, to those applicants who: <br /> <br />1) have previously applied for and/or received legal services, but who <br />have knowingly failed or refused to consummate the legal action initiated on <br />their behalf; or <br /> <br />2) have previously made false statements regarding their financial status <br />to Community Action, Legal Aid, or any other welfare program; or <br /> <br />3) the Legal Aid knows or has a greater than common knowledge of the facts <br />of the case, through prior consultation with opposing parties or third parties <br />affected by the legal matter, and such knowledge could adversely affect the <br />applicant's legal position; or <br /> <br />4) have previously initiated, impliedly or actually, legal action against <br />the Legal Aid, Community Action, the major funding agency, or its attorneys, <br />or any attorney ,acting in behalf thereof; or <br /> <br />5) refuse to take further legal action in parent-child cases recommended <br />by the Program Director to protect the rights and interests of the children of <br />the applicant, to specifically include the initiation of paternity suits and <br />contempt actions for the obtaining or collection of unpaid child support. <br /> <br />E. MISCELLANEOUS PROVISIONS <br /> <br />GENERAL: Legal assistance will be provided to those eligible persons <br />regardless of race, creed, color, nationality, age, sex, religion, or <br />political affiliation. Legal assistance will not be withheld from any group, <br />class, type or category of persons, if they otherwise meet the requirements of <br />eligibility under this Program. <br /> <br />EMERGENCY QUALIFYING: In situation where applicants require immediate <br />legal action to prevent irreparable injury or loss, or a court has designated <br />a specific hearing date which precludes obtaining private counsel, either the <br />major funding agency, Community Action, or the Program Director may waive <br />formal qualifications and provide the requisite legal assistance until a <br />formal application can be reviewed. <br /> <br />4 <br />
