<br />APPENDtx <br /> <br />B. <br /> <br />VOLUNTARY PRO BONO PROGRAM <br /> <br />OBJECTIVE: <br /> <br />The objective of the voluntary pro bono program is to supplement the <br />current legal services provided to the qualified indigents under the Program <br />operated by Legal Ajd, and to increase the level and quality of services <br />provided indigents by private attorneys voluntarily handling indigent matters. <br /> <br />PURPOSE: <br /> <br />The purpose is to increase the number and variety of legal matters <br />handled by Legal Aid, to insure justice is not denied merely on the basis of <br />inability to pay for legal services. <br /> <br />HAYS COUNTY BAR ASSOCIATION: <br /> <br />The Hays County Bar Association shall support, sponsor, or have <br />complete control over the pro bono program. In compliance with the strong <br />recommendations of the State Bar of Texas, the approval and support of the <br />local bar association is required prior to establishment of such program. <br /> <br />PRO BONO PROGRAM: <br /> <br />The pro bono program shall include the Community Action and Legal Aid <br />input in coordination with the Hays County Bar Association, Inc. (Bar <br />Association), and should generally be handled as follows: <br /> <br />1. Community Action to determine the financial eligibility of the <br />applicant, and provide written notice of whether or not the applicant meets <br />the current eligibility guidelines. <br /> <br />2. Community Action provides such written notice to Legal Aid, <br />executed by an authorized individual of Community Action. <br /> <br />3. Legal Aid determines the legal needs of the applicant, and handles <br />same if only consultation is required. In those cases where more legal <br />services are necessary than consultation and advice, Legal Aid will prepare <br />the affidavit of indigency and have same notarized. If necessary, Legal Aid <br />will provide a motion and order appointing an attorney. Legal Aid will then <br />refer the case to an attorney who bas agreed to accept voluntary cases, and <br />will include a basic information and intake form for the use of the attorney. <br /> <br />4. The attorney assigned said case shall handle such case as all <br />other legal matters handled by such attorney. <br /> <br />5. The attorney will notify Legal Aid immediately if a conflict <br />exists or of any reason why the attorney cannot handle such matter, in order <br />that Legal Aid may immediately seek another attorney to handle such case. <br /> <br />1 <br />
