<br />39 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting August 11, 1986 Page 10 <br /> <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 31, MUNICIPAL AIRPORT, <br />OF THE CODE OF ORDINANCES OF SAID CITY, TO ADD ARTICLE <br />II, SECTIONS 31-10 THROUGH 31-17 ESTABLISHING THE STANDARD <br />OPERATING PROCEDURES AND REGULATIONS FOR THE SAN MARCOS <br />MUNICIPAL AIRPORT OF SAID CITY, AND DECLARING AN EFFECT- <br />IVE DATE. <br /> <br />Mr. Farr moved for approval of the Ordinance on first reading and Mayor <br />Younger seconded the motion, which passed unanimously. Mr. Hankins <br />stated Advertisements had been inadvertently left iü the Ordinance, <br />and it would be corrected before the next reading. <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance on <br />second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE GENERAL ZONING ORDINANCE <br />OF THE SAN MARCOS CODE OF ORDINANCES BY ADDING DEFINI- <br />TIONS FOR GROUP HOME, NONCONFORMING LOT, RESIDENTIAL <br />CARE FACILITY; BY ADDING GROUP HOME AS A PERMITTED USE <br />IN ALL RESIDENTIAL DISTRICTS IN CONFORMANCE WITH STATE <br />LAW; BY ADDING RESIDENTIAL CARE FACILITY AS A SPECIFIC <br />USE IN PARTICULAR DISTRICTS; BY PROVIDING SUPPLEMENTAL <br />AREA REQUIREMENTS; BY PROVIDING REGULATIONS FOR NON- <br />CONFORMING LOTS; BY REDEFINING THE POWERS OF THE BOARD <br />OF ADJUSTMENTS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on second reading and <br />Mr. Nicola seconded the motion. Mr. Robbins showed the Council slides <br />of spacing between houses allowed by our present City Ordinance. Mayor <br />Younger moved to amend the Ordinance to add the recommendations contained in <br />the a memorandum to the Council from Frank Robbins dated August 11, <br />1986, and Ms. Kissler seconded the motion. On roll call the following <br />vote was recorded: <br /> <br />AYE: Brown, Younger, Kissler, Nicola. <br /> <br />NAY: Farr. <br /> <br />ABSTAIN: Coddington, Guerra. <br /> <br />Mayor Younger moved to amend the Ordinance in Section 31 (Section 36(H) (1)) <br />to add the recommendations contained in the memorandum to the Council <br />from Dan Gibson dated August 6, 1986 and Ms. Kissler seconded the <br />motion. On roll call the following vote was recorded: <br /> <br />AYE: Younger, Kissler, Nicola. <br /> <br />NAY: Farr. <br /> <br />ABSTAIN: Brown, Coddington, Guerra. <br /> <br />The motion failed. Mr. Hankins stated in the definition of our Ordinance <br />residence group home would be six persons or less. If more than two of <br />the persons are unrelated, then they would have to qualify as a group <br />home. If the Council wants the State Law to apply that group homes <br />can be no closer together than. one-half mile, that provision would have <br />to be added to our Ordinance. Mr. Brown moved to amend the Ordinance <br />
