<br />38 <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting August 11, 1986 Page 9 <br /> <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REPEALING SECTION 18-6 OF THE SAN MAR- <br />COS CODE OF ORDINANCES AND ADOPTING A NEW SECTION 18-6 <br />PROHIBITING CONSUMPTION OF ALCOHOLIC BEVERAGES IN CITY <br />PARKS EXCEPT WITH WRITTEN PERMISSION OF THE PARKS AND <br />RECREATION DIRECTOR; PROVIDING FOR PERMITS; DECLARING <br />THAT VIOLATION OF THIS ORDINANCE IS A MISDEMEANOR PUNISH- <br />ABLE BY A FINE; REPEALING SECTION 18-7 OF SAID ARTICLE <br />OF SAID CHAPTER OF SAID CODE AND ADOPTING A NEW SECTION <br />18-7 TO REVISE THE FEE SCHEDULE FOR USE OF PARK AND RE- <br />CREATIONAL FACILITIES; AMENDING SECTION 18-8 OF SAID <br />ARTICLE OF SAID CHAPTER OF SAID CODE TO PROVIDE FOR A $10 <br />MAINTENANCE FEE FOR USE OF CITY-OWNED BALL PARKS; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Coddington moved for approval of the Ordinance on first reading <br />and Mr. Guerra seconded the motion. Mr. Farr stated provision needed <br />to be made in the Ordinance to allow persons to be able to carry beer <br />and their beer cans to and from the River. Mr. Hankins stated the <br />Ordinance stated you cannot "consume", but does not state you cannot <br />"possess" (Ms. Kissler present at this time - 9:22 p.m.). Police <br />Chief Galchutt stated it might not be understood by persons in the <br />Parks whether or not alcoholic beverages could be "carried" or IIcon- <br />sumed". Mo Johnson, Chairman of the Parks Board, stated there are a <br />lot of neighborhood parks as well as other parks where there are per- <br />sons consuming alcoholic beverages in the mornings and throughout the <br />day. This prohibits children from using the parks, and the Parks Board <br />is trying to eliminate the daily drinkers in the parks. He stated the <br />Ordinance would require a permit for a gathering to drink in the parks. <br />Mayor Younger stated he is opposed to eliminating alcohol in the parks. <br />He stated he wanted to take another look at the fees suggested in the <br />Ordinance too. Mr. Nicola stated if the Council approves this Ordin- <br />ance, he wanted the Cock House and Gazebo included Section 2, Sec. 18-6. <br />(b). Mr. Nicola also stated he would like to see a 50 cent fee for <br />all persons' amùissions to the Swimming Pool (Section 4, Sec. l8-7(d). <br />Mr. Farr moved to amend the Ordinance in Section 4., Sec. l8-7(c) for <br />a fee to be added as follows: $100.00 deposit per complex for the <br />Softball Fields and to amend Section 4, Sec. l8-7(f) to add a deposit <br />of $200.00 per event, and Ms. Kissler seconded the motion, which passed <br />unanimously. Mr. Nicola moved to amend the Ordinance in Section 4, Sec. <br />18~7(d) for admission for everyone to be 50 cents and Mayor Younger se- <br />conded the motion, which passed>'>unanimously. Mr. Nicola moved to amend <br />Section 2, Sec. l8-6(b) to add the Cock House and the Gazebo to the <br />designated areas and Ms. Kissler seconded the motion, which passed <br />unanimously. Mayor Younger moved to amend the Ordinance in Section 2, <br />Sec. 18-6 to delete this section in its entirety and Mr. Guerra second- <br />ed the motion. On roll call the following vote was recorded: <br /> <br />AYE: Coddington, Younger, Guerra. <br /> <br />NAY: Brown, Farr, Kissler, Nicola. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. On roll call for approval of the Ordinance on first <br />reading as amended the following vote was recorded: <br /> <br />AYE: Brown, Farr, Kissler, Nicola. <br /> <br />NAY: Coddington, Younger, Guerra. <br /> <br />ABSTAIN: None. <br />
