<br />39 <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting September 22, 1986 Page 6 <br /> <br /> <br />Bill Haney reviewed with the Council his suggested changes to the <br />Ordinance, a copy of his suggested changes being attached hereto. <br />Mr. Guerra asked Mr. Jenkins to respond whether or not Mr. Haney's <br />suggestions would be a detriment to the citizens of San Marcos. Mr. <br />Jenkins stated in Sec. 30-61(5) 140-150 degrees not a hazard; Sec. <br />30-61(12) the pH is a hard question. the discharge can be accomplisheè <br />if you rely on dilution; Sec. 39-61(17) our plant does not remove sul- <br />fates and Mr. Jenkins wanted the 500 milligrams per liter figure to <br />remain in the Ordinance; regarding swimming pool backwash, Mr. Jenkins <br />stated pools should not be allowed to discharge during peak flow time, <br />but to discharge at off-peak times; Sec. 30-62{4) change from 1% to 2% <br />would be okay; Mr. Jenkins stated the extended date for companies out <br />of compliance is proposed. to be 90 days, but is the Council's option; <br />Sec. 30-64(4) restaurants are considered separately and the fee is de- <br />signed to offset some of the costs. Mr. Farr stated he was supportive <br />of Mr. Haney's recommendation that the City bear costs until a violation <br />is found, as the City's equipment is designed for this monitoring. Mr. <br />Jenkins then reviewed a supplement memo with the Council dated September <br />22, 1986 regarding Sec. 30-64(8) it is logical for the industry to do <br />the same testing the City is required to do and Sec. 30-66(1) the City <br />will have a checklist of chemicals and the industry just checks off what <br />they have. John Meeks reviewed with Council a suggested revision to <br />Sec. 30-64, which is attached to these minutes. He requested Council <br />do a thorough review of the policy guidelines. Fritz Sachtleben stated <br />he has three service stations and said he could not comply with Sec. <br />30-63.4.(c) regarding discharge into hold-haul tanks, because he is <br />unable to service buses in the service bays. Mr. Jenkins stated EPA's <br />requirements are not pinned down, but you have to have a way to catch <br />oils and greases. Mr. Jenkins stated Mr. Sachtleben would not be out <br />of compliance if he catches the changes. Mr. Sachtleben said this <br />Section would not allow him to perform oil changes in his driveway, <br />and Mr. Jenkins stated the driveway does not discharge into the sani- <br />tary sewer system. Roger Storey stated that none of the service sta- <br />tions in San Marcos had the ability to catch water used to clean the <br />areas where oil changes are done. Mr. Jennkins stated there could be <br />a grandfather clause for physical, economical and maintenance criteria. <br />Billy Moore said the purpose of the Ordinance is to comply with require- <br />ments but does not want the citizens to be charged for the sampling. <br />Jeff Hill stated the Chamber of Commerce is not opposed to an Ordinance <br />that will help protect our River, but if it is overly restrictive, it <br />will place a burden on the community. He stated we are being rushed <br />through too quickly. He stated the monitoring by businesses is not an <br />EPA requirement. He stated adjustments are in order and that grand- <br />fathering would be a help. He stated the Chamber of Commerce wants <br />to be able to make recommendations to the Council on this Ordinance <br />in the near future. It was consensus of Council to consider the sug- <br />gestions that have been made at second reading. The Chamber of Commerce <br />is to have their recommendations reviewed by Mr. Jenkins before second <br />reading. On roll call for approval of the Ordinance on first reading, <br />following vote was recorded: <br /> <br />AYL: Brown, Coddington, Farr, Guerra, Kissler, Nicola. <br />NAY: Younger. <br />ABSTAIN: None. <br /> <br /> <br />Mayor Younger introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, fu~ENDING SECTIONS 29-152 OF ThE SAN <br />ä~RCOS CODE OF ORDINANCES BY ADDING A NO-PARKING TOW- <br />AWAY ZONE ON BOTH SIDES OF PLEASANT DRIVE AND DECLARING <br />AN EFFECRIVE DATE. <br />
