<br /> -7- <br />(e) Anytime after three (3) months from the date a dog's <br />registration has been revoked the owne r or handler may <br />request a hearing in municipal court to rei ns ta te the dog's <br />registration. The municipal court Judge may consider the <br />following factors in deciding whether to reinstate the <br />reg istra tion: <br /> ( l) Proof that the dog has been trained not to behave <br /> in the way that resulted in revocation of the <br /> dogOs reg istration; <br /> ( 2) Change in the physical circumstances of the dog) s <br /> residence such as an adequate fence, stake and <br /> chain, etc.; and, <br /> ( 3) Any other factors the judge finds are reasonably <br /> related to correction of the circumstance which <br /> led to the revocation. <br />The city is entitled to reasonable notice of the hearing <br />and of the reasons to be offered by the owner to justify <br />reinstatement of the registration. Such notice and <br />information must be provided to the city attorney" s office at <br />least ten (10) days before the date scheduled for the <br />hearing. <br /> ARTICLE III. IMPOUNDMENT OF &~IMALS <br />Sec. 3-45. Animal Control Officer. <br />(a) The chief of police shall appoint a special officer to <br />be known and described as the animal control officer and fix <br />a salary therefor subject to the approval of the city <br />council. The chief of police may appoint or provide for an <br />assistant or assistants to the animal control officer. The <br />animal control officer dnd his assistant or assistants shall <br />be under the supervision and control of the chief of police. <br />(b) It shall be the duty of the animal control officer and <br />his assistants to pick up and impound all dogs, cattle, <br />horses, jacks, jennets, sheep, goats or like animals found <br />runni ng at large, to take proper care for all such animals <br />impounded, to destroy all such animals that have not been <br />redeemed or sold, and to perform such other duties as may be <br />directed by the city manager under the terms of this article. <br />(c) It shall be the duty of the animal control officer to <br />report in \..¡riting to the chief of police once each month the <br />total number of dogs, cattle, horses, jacks, jennets, sheep, <br />goats or like animáls redeemed, sold or destroyed under the <br />provisions of this article. <br />Sec. 3-46. Fees. <br />There shall be cha rg ed a pound fee of fifteen dollars <br />($15.00) for every dog, cow, horse, jack, jennet, sheep, goat <br />or like animal impounded under the provision of this article; <br />and an additional fee based on the existing kennel fee <br />charged in this area for each day or fraction thereof that <br />any dog remains in such pound; and five dollars ($5.00) per <br />day or fraction thereof that any cow, horse, jack, jennet, <br />sheep, goat or like animal remains in such pound. <br />
