<br /> -5- <br /> C. From and after the effective date of this <br /> ordinance, no building permit nor any <br /> subdivision plat shall be approved within the <br /> area defined as the San Marcos River Corridor <br /> unless the following conditions have been met: <br /> 1. Site Plan Required. <br /> a. All development or construction within <br /> the City limits of San Marcos and <br /> within the SMRC shall be required to <br /> have a site plan approved. This site <br /> plan shall be part of the zoning <br /> application if rezoning is necessary, <br /> and shall be approved by the City <br /> Council. If rezoning is not necessary, <br /> the site plan shall be approved by the <br /> Planning Commission. The Planning <br /> Commission should act on the site plan <br /> within thirty (30) days of its <br /> submission. If the site plan is not <br /> acted on within 30 days, the applicant <br /> may appeal to and request approval from <br /> the City Council which shall consider <br /> the site plan at its next meeting held <br /> at least seven (7) days from filing of <br /> the appeal with the City Secretary. <br /> b. Site plan contents: If the development <br /> is a PUD, the requirements of the PUD <br /> development plan shall apply. If <br /> development is not a PUD, the site <br /> plan, prepared in twenty four (24) <br /> coples, shall contain as a minimum, a <br /> map drawn to scale not smaller than <br /> one-hundred (100) feet to one inch <br /> showing the location of each proposed <br /> structure and impervious cover, the use <br /> or uses to be contained therein, the <br /> number of stories, the gross area of <br /> each structure or impervious cover, all <br /> curb cuts, driving lanes, pedestrian <br /> walks. <br /> Existing trees shall be shown, and may <br /> be shown on a seperate map or aerial <br /> photograph, at a scale of from one (1) <br /> inch to one hundred (100) feet to one <br /> ( 1) inch to five hundred (500) feet. <br /> c. The approved site plan shall be filed <br /> by the Chief Building Official who <br /> shall issue building permits and <br /> certificates of occupancy only for <br /> development and construction that <br /> complies with the approved site plans <br /> and renderings. <br /> 3. All subdivisions within the SMRC, which <br /> are larger than two acres, or which will <br /> contain non-residential structures that <br /> total 5000 square feet, or more, or which <br /> will contain more than six (6) residential <br /> units shall be Planned Unit Development <br /> (PUD) or Planned Development District <br /> (PDD) subdivisions and shall be zoned PDD <br /> or PUD. The required development plans <br /> for these subdivisions shall meet the <br /> requirements of the plans required of the <br /> PDD the PUD. <br />
