Approved PUD or PDD development plans for <br /> subdivisions outside the city limits shall <br /> be the basis for the future zoning <br /> districts of the SMRC or PUD or PDD <br /> subdivisions when these subdivisions are <br /> annexed. <br /> D. This article sets out additional requirements <br /> for the subdivision and development of land <br /> located in the San Marcos River Corridor. A <br /> person wishing to subdivide land in the <br /> Corridor must comply with both these special <br /> requirements and with the applicable <br /> requirements of Appendix C, Subdivisions, of <br /> the City Code. In case of conflict between <br /> the requirements of this Chapter and those of <br /> Appendix C, or of any other ordinance, the <br /> requirements of this article shall govern. <br /> E. Exceptions: <br /> 1.The additional requirements of the San <br /> Marcos River Corridor ordinance shall not <br /> apply to development, redevelopment, repair, <br /> or construction, or reconstruction of a single <br /> family detached residence on a properly <br /> platted subdivision lot that has been properly <br /> platted before the effective date of this <br /> ordinance. "Properly platted" as used herein <br /> means that the lot as it exists in its present <br /> form, dimension, and metes and bounds has been <br /> approved by those bodies required by law to <br /> approve such plats and is legally recorded in <br /> the Office of the County Clerk. <br /> 2. Erodible soils. If a development is on <br /> land which has been included within the <br /> San Marcos River Corridor because it is <br /> shown on the Hays, Guadalupe or Caldwell <br /> County Soil Conservation Service soil <br /> survey maps as being on soil s that have a <br /> high or severe water erosion hazard, is <br /> not within 200 feet of the bank of the San <br /> Marcos River, and is not within a <br /> floodplain within the SMRC, and a soils <br /> test, as verified by the Director, shows <br /> that the development is not on soils that <br /> have a high or severe water erosion <br /> hazard, and that the storm water runoff <br /> from the development will not flow over <br /> soils that have a high or severe water <br /> erosion hazard, the development shall not <br /> be required to meet the additional <br /> requirements of this ordinance. <br /> 3. Subdivisions in which the smallest lot is <br /> ten (10) acres or greater in size shall <br /> not be required to be a PDD or PUD <br /> subdivision or be in a PDD or PUD zoning <br /> district. <br /> Sec. 3. Definitions. <br /> The following words, terms and phrases, when used <br /> in this ordinance, shall have the meanings ascribed <br /> to them in this section, except where the context <br /> clearly indicates a different meaning: <br /> Applicant: A person, business, corporation or <br /> entity applying for approval of development plans <br /> under this ordinance for property within the <br /> boundaries of the San Marcos River Corridor. <br />
