<br /> -9- <br /> Unpaved safety lanes must be <br /> clearly marked and the safety lanes <br /> shall be delineated and designated <br /> as safety lanes on the appropriate <br /> plat(s) required by Appendix C, <br /> Subdivisions. The City of San <br /> Marcos shall not be liable for <br /> damage to underground utilities <br /> beneath designated safety lanes <br /> caused by fire fighting equipment. <br /> 4. All private streets, alleys, and safety <br /> lanes shall be owned and maintained by a <br /> community association, or other legal <br /> entity as established in Section 504 of <br /> this article; however, a written <br /> agreement between the City of San Marcos <br /> and the legal entity shall be provided <br /> permitting vehicles and/or personnel of <br /> the City of San Marcos when on official <br /> business to use the private streets and <br /> safety lanes for any purpose, at any <br /> time, without liability. The City of <br /> San Marcos shall be permitted to remove <br /> at any time any and all obstructions of <br /> any type in safety lanes and to assess <br /> the cost of removal to the owner(s) of <br /> the obstruction. <br /> 5. pedestrian access. Sidewalks shall be <br /> provided on public and private streets <br /> in accordance with Appendix C, <br /> Subdivisions. Sidewalks on both sides <br /> of streets may not be required when an <br /> alternative pedestrian circulation plan <br /> has been submitted and determined <br /> acceptable by the Planning Commission. <br /> The alternative pedestrian circulation <br /> must show the location and arrangement <br /> of all-weather walkways. In considering <br /> the circulation plan, the Planning <br /> Commission shall assure that access to <br /> and along the walkway areas is safe, <br /> convenient, and provide pedestrians with <br /> adequate paths of movement. <br /> 206. Parking and Off-Street Loading <br /> Off-street parking and truck loading <br /> requirements shall be as provided in Section <br /> 37 of the General zoning Ordinance of the <br /> Code with the following exceptions: <br /> 1. Residential Off-Street Parking. If <br /> off-street parking is provided entirely <br /> on an individual residential lot, a <br /> minimum of two (2) off-street parking <br /> spaces are required exclusive of a <br /> private garage or carport. <br /> 2. Off-street parking spaces shall conform <br /> to the minimum size requirements of <br /> Section 37 of the General Zoning <br /> Ordinance and shall be so located that <br /> vehicle parking will not interfere with <br /> sidewalk accessibility.
