<br />Mayor Craddock opened the public hearing and asked if anyone wished
<br />to speak in favor of the zoning request. Tim Herman was present re-
<br />presenting Wooten Investments, to answer any questiornof the Council.
<br />No one else wished to speak in favor or in opposition to the zoning
<br />change, so Mayor Craddock closed the public hearing. Mr. Hankins
<br />advised the Council it would take a three-quarter's vote of approval
<br />by the Council to be approved on first reading because it had been
<br />denied by the Zoning Commission in November, 1983 (The Zoning Commis-
<br />sion's vote of approval in December, 1983 is null and void, as it was
<br />considered by the Commission and denied less than twelve months prior
<br />[November, 1983]). Mr. Farr moved for approval of the Ordinance on
<br />first reading and Mr. Guerra seconded the motion, which passed unani-
<br />mously.

<br />Mayor Craddock introduced a public hearing and adoption of an Ordin-
<br />ance on third and final reading, the caption which was read as follows:

<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE
<br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13,
<br />1984 (VOL. 66) BY ZONING 2.3 ACRES, MORE OR LESS,
<br />OF LAND AREA IN THE J.M. VERAMENDI LEAGUE NO.2 IN
<br />SAN MARCOS, HAYS COUNTY, TEXAS, BEING A PORTION OF
<br />THAT 45.1 ACRE TRACT OF LAND DESCRIBED IN A DEED FROM
<br />THEO SCHAWE, ET UX, TO LEWIS DOBIE, ET UX, DATED DECEM-
<br />BER 15, 1953 AND RECORDED IN VOLUME 158, PAGE 80 OF
<br />THE HAYS COUNTY DEED RECORDS, BEING PROPERTY LOCATED
<br />ON UHLAND ROAD EAST AT RIVER ROAD FROM "PD" (PRE-DE-
<br />VELOPMENT DISTRICT) TO "c" (COMMERCIAL DISTRICT);
<br />M1ENDING THE FUTURE LAND USE PLAN (MAP) OF THE MASTER
<br />PLAN OF SAID CITY AND DECLARING AN EFFECTIVE DATE.

<br />Mayor Craddock opened the public hearing and asked if anyone wished

<br />did, so Mayor Craddock closed the public hearing. Mr. Guerra moved
<br />for adoption of the Ordinance on third and final reading and Ms.
<br />Kissler seconded the motion. Mr. Farr then moved to amend the
<br />Ordinance to add the wording in the caption "AMENDING THE FUTURE
<br />LAND USE PLAN (MAP) OF THE MASTER PLAN OF SAID CITY" and adding
<br />"SECTION 2. That the tract of property described in Section I above
<br />which is in an area shown on the Future Land Use Plan (Map) of the
<br />Master Plan of the City of San Marcos as High and Low Density Resi-
<br />dential henceforth shall be shown on said Map as Commercial". Mayor
<br />Craddock seconded Mr. Farr's motion, which passed unanimously. The
<br />Council then adopted the Ordinance unanimously on third and final
<br />reading.
