That Section 9 (c) of Appendix F, Interim <br /> Drainage and Erosion Control Ordinance, of the Code of Ordinances <br /> of the City of San Marcos, Texas be amended to read as follows: <br /> Section 9. Drainage improvements maintenance criteria. <br /> . .. <br /> (c) Duly authorized inspectors of the City may law- <br /> fully enter onto the land or premises where pro- <br /> perty owners are required to maintain drainage <br /> facilities, at reasonable times, for the purpose <br /> of inspection of the maintenance required. The <br /> City of San Marcos City Engineer, or his designated <br /> representative, shall inspect the premises of <br /> each such facility approved pursuant to this <br /> chapter at least once per year. Where noncom- <br /> pliance is found, the City shall request in <br /> writing that the property owner comply. This <br /> notice shall describe the measures required to <br /> be taken. If, within thirty (30) days of the <br /> notice, the maintenance required is not accom- <br /> plished, the City may bring an action in a court <br /> of competent jurisdiction to require the pro- <br /> perty owner to accomplish necessary maintenance. <br /> SECTION 13. That Section 14 of Appendix F, Interim Drainage <br /> and Erosion Control Ordinance, of the Code of Ordinances of the <br /> City of San Marcos, Texas be amended by adding the following: <br /> Section 14. Permit fees. <br /> . .. <br /> Any application for a site development permit <br /> that is rejected by the City Engineer may only be <br /> re-submitted as an original application and only <br /> after the payment of the fee required to be paid <br /> for an original application, providing that no <br /> application may be rejected unless it has been <br /> reviewed in its entirety and the applicant has <br /> had an opportunity to respond to the City Eng- <br /> ineer's complete review. Any time used to res- <br /> pond to the City Engineer's review shall cause <br /> the time limits for review to be extended a like <br /> amount of time. <br /> SECTION 14. That Section 15 of Appendix F, Interim Drainage <br /> and Erosion Control Ordinance, of the Code of Ordinances of the <br /> City of San Marcos, Texas be amended to read as follows: <br /> Section 15. Penalty. <br /> . .. <br /> Any person violating any of the provisions of <br /> this chapter and any person who does any act <br /> requiring a permit under the provisions hereof <br /> without a valid permit, and any person who fails <br /> or refuses to comply with any of the provisions <br /> hereof, shall be guilty of a misdemeanor and upon <br />
