<br /> 5.2.2 Payment shall be made to the CONSULTANT during Phase 1 <br /> and Phase 2 upon presentation of statements for such services to the <br /> OWNER. In no case shall partial payments be in excess of the value of <br /> the services completed at the time a statement is rendered. <br /> 5.2.3 Payment for Phase 3 Services will be made to the <br /> CONSULTANT on a monthly basis in direct proportion to the contractor1s <br /> earnings. The CONSULTANT will submit a statement each month for this <br /> payment. <br /> 5.3 PAYMENT FOR SPECIAL SERVICES <br /> 5.3.1 Scope - under this Article, if the OWNER elects to have <br /> the CONSULTANT furnish Special Services as set forth in Article 4.2, <br /> the payment for personnel other than Charles Wi 11 i s & Associates, <br /> Inc., will be made at cost plus a fixed fee. The amount of the fixed <br /> fee will be agreed upon prior to the CONSULTANT underta ki ng the <br /> special Services. The billing period for all Special Services will be <br /> calendar months. <br /> 5.5 LATE PAYMENT TO CONSULTANT <br /> 5.5.1 All payments for services properly rendered by the <br /> CONSULTANT that have not been paid within ninety (90) days after <br /> becoming due, shall thereafter accrue interest at the rate of eight <br /> percent (8%) per annum, provided that any amount legitimately in <br /> dispute by OWNER shall not incur the eight percent (8%) rate. <br /> ARTICLE 6 <br /> SERVICES BY THE OWNER <br /> In general, the OWNER will render services as follows: <br /> 6.1 Provide available criteria and full information as to the <br /> OWNER'S requirements for the PROJECT. <br /> 6.2 Assist the CONSULTANT by providing all available written <br /> data pertinent to plan operations, previous reports, process <br /> experimental data, and any other data affecting the design and/or <br /> construction of the PROJECT. <br /> 6.3 Furnish the CONSULTANT all necessary reports on the results <br /> of laboratory test, inspection of samples, materials testing, mill <br /> tests, and other testing services performed for quality control pur- <br /> poses by an independent testing laboratory. <br /> 6.4 Furnish the CONSULTANT all necessary field surveys which are <br /> requi red to collect design data such as horizontal and vertical con- <br />
