<br /> HBE Program <br /> Page 5 <br /> (3) initiate legal action In a timely manner in order to ensure <br /> compliance with policies and procedures set forth ln the <br /> MBE Program. <br /> (4) continuous review of HBE involvement during the project. <br /> ( 5) annually report the progress and coQpliance of the MBE <br /> program to the City Council through the City Manager, and <br /> recommend annual goals and program changes which may be <br /> necessary to improve the overall effectiveness of the <br /> program. <br /> All departments listed above shall make certain that the correct <br /> goals are included in all specification packages and requests for <br /> bids or proposals. The inclusion of the MBE Program requirements <br /> and goals in a contractor's bid package shall become a binding <br /> part of his/her contract. <br /> GOALS <br /> A committee, known as the MBE/Airport Committee, shall be established <br /> for the purpose of identifying MBE Goals for the Municipal Airport Im- <br /> provement Projects. This committee, which shall meet annually, shall <br /> consist of one member of the Minority Commission, one member of the <br /> Airport Commission, and one member of the City Council. The committee <br /> shall be responsible for determining overall MBE goals for the coming <br /> fiscal year. During the process of developing the Ì'1BE goals, the <br /> committee will review and consider information on the availability of <br /> MBE's ln the San Marcos trade area, as well as any other information <br /> pertinent to the setting of goals. The goals will be expressed as a <br /> percentage of the total estimated dollar amount of all Airport <br /> Improvement Program (AIP) projects during the fiscal year. The per- <br /> centage goals and the breakdown of women and minority owned project <br /> dollar amounts for each project will be available in the airport <br /> manager's office. <br /> PROCEDURES FOR NAi.'vlING MBE' S IN BIDS <br /> When the San Marcos Municipal Airport issues solicitations for bids on <br /> DOT--financial1y assisted contracts, the solicitation shall include the <br /> MBE goals set for the contract, and a requirement that bidders include <br /> a written assurance that they will meet the goals ln their bids. The <br /> solicitation shall also include notification that after the opening of <br /> bids and before the awarding of a contract, those bidders who have sub- <br /> mitted a prlce determined to be reasonable and who wish to remain ln <br /> competition will be required to submit the names of those MBE's included <br /> in the bid. This information shall also contain a description of the <br /> work each MBE will perform and the dollar volume of that work on each <br /> MBE sub-contract. The time interval between the opening of the bid and <br /> the awarding of the contract will be included In the solicitation. This <br /> period will normally be from 5 to 15 days but may be shorter if so <br /> stated in the solicitation. The actual clause to be used is: <br />
