<br /> MBE Program <br /> Page 6 <br /> "After the bid opening and before award of the contract, <br /> those bidders/proposers that have submitted a contract price <br /> that has been determined to be reasonable will be asked by <br /> the City, as a condition of remaining in competition for <br /> the award, to submit within days the names of the MBE's <br /> they propose to use, the type of sub-contract work each MBE <br /> will perform, and dollar value of each proposed MBE <br /> sub-contract. " <br /> CONTRACT AWARD CRITERIA <br /> In order for a bidder to win a contract, he/she must fulfill the goals <br /> for both the minority and women owned businesses, as well as have a <br /> bid price which is lower than that of all other bidders who have met the <br /> MBE goals, and be acceptable to the City of San Marcos. If one bidder <br /> has met all these requirements, he/she will be awarded the contract. <br /> If one bidder does meet the MBE goal and submits a reasonable price, <br /> all other bidders that do not meet the MBE goal will be assumed to have <br /> not made a reasonable effort, and therefore, will be ineligible for the <br /> contract. In the event none of the biddersmeets both the goals of price <br /> and minority/women owned businesses, further consideration will be given <br /> with the bids laid out according to the total level of MBE percentage <br /> that the goal requires. For example: <br /> % of % of MBE <br /> Bidder Women ~1BE Goal Minority MBE Goal Credit <br /> -- -- <br /> A 6 6 9 8 14 <br /> B 9 6 8 8 14 <br /> C 5 5 7 7 12 <br /> With the bids arranged from the highest MBE credit to the lowest, each <br /> bid will be reviewed, starting with the one with the highest MBE credit. <br /> The bids will be reviewed, until one is reached which falls at or below <br /> the pre-determined dollar value level for the contract. At this point, <br /> the City will determine whether this bidder has made a sufficient <br /> reasonable effort to secure MBE's. A sufficient reasonable effort will <br /> be determined by bidders record of: <br /> (1) Attendance at pre-bid meetings <br /> (2) Advertising in general, minority focus and trade media, <br /> which must be run for a minimum of 10 consecutive days <br /> (media schedules and bid closing dates permitted) <br /> ( 3) Efforts at notifying MBE's in writing of the desired <br /> employment opportunities <br />
