On roll call the following vote was recorded: <br /> AYE: Brown, Coddington, Farr, Craddock, Guerra. <br /> NAY: Moore. <br /> ABSTAIN: None. <br /> Mayor Craddock introduced for consideration Item 7A(5) which was re- <br /> moved from the consensus agenda, being approval of an Ordinance on <br /> second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING CHAPTER 16 OF THE CODE OF <br /> ORDINANCES OF SAID CITY TO ADD THERETO AN ARTICLE III, <br /> UNLAWFUL POSSESSION OF CITY PROPERTY, TO PROVIDE THAT <br /> IT IS UNLAWFUL FOR ANY PERSON TO BE IN POSSESSION OF A <br /> STREET SIGN, TRAFFIC SIGN, OR ANY PART THEREOF WHICH <br /> IS THE PROPERTY OF SAID CITY WITHOUT THE EFFECTIVE CON- <br /> SENT OF SAID CITY; PROVIDING FOR PENALTIES FOR VIOLATIONS <br /> OF SAID ARTICLE; AND, DECLARING AN EFFECTIVE DATE. <br /> Mr. Guerra moved for approval of the Ordinance on second reading <br /> and Mayor Craddock seconded the motion. Mr. Moore asked why there <br /> is a greater fine for street signs than stop signs. Mr. Hankins re- <br /> plied it is regulated by state law and street signs had a larger fee <br /> for health and. fire safety reasons. On roll call the following vote <br /> was recorded: <br /> AYE: Brown, Coddington, Farr, Craddock, Guerra. <br /> NAY: Moore. <br /> ABSTAIN: None. <br /> Mayor Craddock introduced for consideration Item 7A(6) which was re- <br /> moved from the consensus agenda, being approval of an Ordinance on <br /> second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, MAKING IT UNLAWFUL TO RECEIVE OR AS- <br /> SIST IN RECEIVING UNAUTHORIZED CABLE SERVICE; ESTABLISH- <br /> ING A RANGE FOR FINES FOR VIOLATION OF THIS ORDINANCE; <br /> AND DECLARING AN EFFECTIVE DATE. <br /> Mayor Craddock moved for approval of the Ordinance on second reading <br /> and Mr. Guerra seconded the motion. Mr. Coddington stated he did <br /> not think the City should be involved in this enforcement, that the <br /> State through the District Attorney should enforce it. Mr. Hankins <br /> stated he did not think the City would have any difficulty in enforc- <br /> ing this matter.
