<br /> 33 <br /> STATE OF TEXAS <br /> CONTRACT FOR SERVICES <br /> COUNTY OF HAYS <br /> KNOW ALL PERSONS BY THESE PRESENTS: <br /> That the City of San ~1arcos, Texas, a municipal <br /> corporation existing by and under the laws of the State of <br /> Texas, acting through authority conferred on its Mayor, Emmie <br /> Craddock, by action approved on December 17, 1984, <br /> hereinafter "City", and the San Marcos Chamber of Commerce <br /> hereinafter "Chamber" acting by and through its President, <br /> Vic Isaak, enter into this agreement pursuant to the terms <br /> and provisions of Chapter 26, Article II, of the Code of <br /> Ordinances for the City of San Marcos, Texas. <br /> "HTNESSETH <br /> I. <br /> That City has enacted by ordinance a hotel room <br /> occupancy tax to be levied upon the occupancy of any room <br /> furnished by any hotel within City. Pursuant to Section <br /> 26-21 of the Code of Ordinances of City, "Use of Proceeds", <br /> City does hereby agree to allocate funds from the revenue of <br /> said tax to Chamber. The allocation of funds to Chamber is <br /> hereby agreed to be 90% of four sevenths (4/7) of the gross <br /> of all funds collected from the hotel room occupancy tax. <br /> Furthermore, it is expressly agreed that Chamber shall be <br /> entitled to operating and administrative expenses incurred in <br /> fulfilling Chamber's responsibilities under this Contract. <br /> Said operating and administrative expenses shall not exceed <br /> fifteen percent (15%) of the total allocation of such funds <br /> collected from the hotel room occupancy tax and received by <br /> Chamber. <br /> II. <br /> Chamber hereby agrees to expend said fund for the <br /> activities set out in Section 26-21 of the Ordinance. Those <br /> activities shall include advertising for general promotional <br /> and tourist advertising of the City of San Marcos and its <br />
