The Council then voted unanimously for <br />approval of Ordinance on first reading. <br />Mayor Narvaiz introduced a public hearing and consideration adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAROCS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM "LDR" LOW <br />DENSITY RESIDENTIAL TO "MDR" MEDIUM DENSITY RESIDENTIAL, FOR A 0.2479 <br />ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 114 OLIVE STREET; FOR <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT <br />FROM "SF -6" SINGLE FAMILY RESIDENTIAL DISTRICT TO "DR" DUPLEX <br />RESIDENTIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Narvaiz closed the public hearing. Mr. Guerrero moved <br />for adoption of the Zoning Ordinance, and Ms. Couch seconded the motion. <br />Ms. Barrett, Director of Planning and Development, stated the City went <br />through implementation of new zoning, which refined Duplex Unrestricted. <br />She stated this zoning has the same residency restrictions as Single Family. <br />She also stated there can not be no more than two unrelated person in either <br />side of the duplex. She stated these applicants are divorced parents who <br />will each live on one side so they can have joint custody and raise their <br />children together. Mr. Thomaides stated he feels the Council is voting on a <br />rezoning of the location. He stated the City has situations around Historic <br />District with larger houses with lots of large bedrooms. He stated he feels <br />that the situation of this structure could change in the future and the <br />applicants could change as well and he feels the single family zoning should <br />be maintained. The Council then voted on the Zoning Ordinance, the following <br />vote was recorded: <br />AYE: Narvaiz, Guerrero and Robertson. <br />NAY: Thomaides, Couch, Bose, and Jones. <br />ABSTAIN: None. <br />Motion for approval of Zoning Ordinance failed. <br />Mayor Narvaiz introduced for consideration of adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY'S 2006 -2007 BUDGET TO TRANSFER FUNDS FROM THE <br />ELECTRIC UTILITY FUND BALANCE FOR USE BY THE ELECTRIC UTILITY TO <br />PURCHASE ADDITIONAL TRANSFORMERS; AND DECLARING AN EMERGENCY. <br />
