<br /> 10. Insurance, Rebuilding And Repair Of Damage To Structures. <br /> Lessee agrees to keep and maintain in effect, fire insurance with <br /> extended coverage, In a sum not less than Seventy Five Thousand <br /> Dollars ($75,000.00) with a company or companies licensed to do <br /> insurance business in Texas. Copies of said policies shall be pro- <br /> vided to Lessor within thirty (30) days from the date Lessee takes <br /> possession of said premises. In the event the demised premises, <br /> a major portion thereof or any structures or improvements located <br /> on said demised premises shall be damaged or destroyed by casualty, <br /> fire or otherwise, to an extent which renders said premises un- <br /> fit for Lessee's purposes, as Lessee may determine, Lessee may <br /> rebuild or repair such damaged or destroyed portions. In the <br /> event Lessee elects not to proceed with the rebuilding or repair <br /> of any structures or other improvements on the demised premises <br /> (if so damaged or destroyed), all insurance proceeds shall re- <br /> dound to Lessor. If Lessee shall fail to proceed with such repair <br /> or rebuilding for a period of ninety (90) days after the receipt <br /> of insurance proceeds then either party may cancel and terminate <br /> this lease and all insurance proceeds so received shall be turned <br /> over to Lessor:. If Lessor elects to terminate said lease pursuant <br /> to this paragraph, Lessor shall give Lessee ten (10) days written <br /> notice of intent to so terminate. If Lessee fails and refuses to <br /> begin rebuilding and/or repair within ten (10) days of receipt of <br /> said notice, Lessor may terminate this lease. <br /> 11. Sidewalks, Parking Areas, Yards And Landscaped Areas. <br /> Lessee shall keep the sidewalks and parking areas in good condi- <br /> tion and repair and shall provide the necessary maintenance to <br /> the yard and keep all landscaped areas in a sightly condition. <br /> 12. plans And Specifications. Lessor shall approve any <br /> and all plans, specifications and/or designs for any structure <br /> or improvement to be placed on said demised premises. Lessee <br /> shall cause any construction on said demised premises to be <br /> prosecuted with diligence and shall cause all required building <br /> permits for said construction to be obtained. <br /> 13. Quiet Possession. Lessor shall warrant and defend <br /> Lessee in the enjoyment and peaceful possession of the premises <br /> during the aforesaid term. <br /> -5- <br />
