<br />78 <br /> <br /> <br /> <br /> <br />Regular Meeting June 24, 1985 Page 4 <br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DENYING A RATE INCREASE REQUEST OF THE <br />LOWER COLORADO RIVER AUTHORITY IN SAID CITY; DETER- <br />MINING REASONABLE RATES; PROVIDING FOR SCHEDULES, <br />SEVERABILITY AND REPEAL OF CONFLICTING ORDINANCES; <br />AND DECLARING AN EMERGENCY. <br /> <br />Mr. Coddington moved for adoption of the Ordinance on emergency and <br />Mayor Craddock seconded the motion. Mayor Craddock stated that the <br />adoption of this Ordinance would be in conformity with the P.U.C. <br />ruling on the matter. The City Manager stated that the adoption <br />of this Ordinance would be pro forma on the part of the Council <br />since the rate increase request of L.C.R.A. had already been <br />decided by the Commission. He further stated that the $35,000,000 <br />rate increase request by L.C.R.A. had not only been denied by the <br />P.U.C. but that L.C.R.A.'s rates had even been reduced by the P.U.C., <br />which decision, to his knowledge, is being appealed. Mayor Craddock <br />stated that she was pleased that the P.U.C. adopted in large measure <br />the recommendations that were made by the cities of San Saba, Kerr- <br />ville and San Marcos, and further stated that those cities had worked <br />very diligently to oppose the rate increase request sought by L.C.R.A. <br />The Council then voted unanimously for adoption of the Ordinance on <br />emergency. <br /> <br />Mayor Craddock introduced for consideration adoption of an Ordinance <br />on emergency, the caption of which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, DELETING SECTION 10-3 OF ARTICLE I OF <br />CHAPTER 10 OF THE CODE OF ORDINANCES OF SAID CITY; <br />AMENDING SECTION 10-38 OF ARTICLE III THEREOF TO <br />ADOPT THE 1976 EDITION OF THE FIRE PREVENTION CODE; <br />AMENDING SECTION 10-39(a) OF ARTICLE III THEREOF <br />TO INCREASE THE PENALTY FOR VIOLATIONS; AMENDING <br />SECTION 10-39(c} OF ARTICLE III THEREOF REGARDING <br />THE EXTENT OF THE APPLICABILITY OF ARTICLE III <br />PROVISIONS; AMENDING SECTION 10-41 OF ARTICLE III <br />THEREOF TO DELETE THE PRESENT AMENDMENT OF SECTION <br />16.75 OF THE 1970 EDITION OF THE FIRE PREVENTION CODE <br />FOUND IN SAID SECTION 10-41 AND SUBSTITUTING THEREFOR <br />AMENDMENTS TO THE 1976 EDITION OF THE FIRE PREVENTION <br />CODE REGARDING THE STORAGE, SALE, DISCHARGE AND <br />MANUFACTURE OF FIREWORKS; RESTRICTIONS ON THE TRANS- <br />PORTATION, PARKING AND GARAGING OF TANK VEHICLES¡ <br />RESTRICTIONS ON THE TRANSPORTATION, PARKING AND <br />GARAGING OF MOTOR VEHICLES CONTAINING HAZARDOUS <br />CHEMICALS OR OTHER DANGEROUS ARTICLES, LIQUEFIED <br />PETROLEUM GAS OR NATURAL GAS PRODUCTS, OR OTHER <br />FLAMMABLE OR COMBUSTIBLE LIQUIDS¡ DESIGNATION, <br />MARKING AND ENFORCEMENT OF NO PARKING REGULATIONS <br />IN FIRE LARES; DELETING SECTIONS 10-43, 10-44 AND <br />10-45 OF ARTICLE III THEREOF; AMENDING SECTIONS <br />10-46 AND 10-47 OF ARTICLE III THEREOF TO PROVIDE <br />THAT TRANSPORTATION OF EXPLOSIVES AND BLASTING <br />AGENTS AND HAZARDOUS CHEMICALS AND OTHER DANGEROUS <br />ARTICLES BY MOTOR VEHICLES SHALL COMPLY WITH DE- <br />PARTMENT OF TRANSPORTATION REGULATIONS; RENUMBERING <br />CERTAIN SECTIONS OF SAID CHAPTER OF SAID CODE OF <br />ORDINANCES; PROVIDING FOR THE REPEAL OF ALL ORDI- <br />NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; <br />PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Farr moved for adoption of the Ordinance on emergency and Mr. <br />Guerra seconded the motion. Mr. Coddington stated that he thought <br />this Ordinance had been adopted at the previous meeting of the <br />Council.
