Mr. Swift asked if the City <br />had the right to require a site plan in the ETJ, and Frank Robbins <br />responded Section 2C can regulate land but not buildings in the ETJ. <br />City Attorney Hankins responded this section would be cleared up. Mr. <br />Swift said he objected to only single-family homes on acre lots being <br />allowed to be constructed along the river. No one else wished to speak <br />in favor or in opposition, so Mayor Craddock closed the public hearing. <br />Mr. Farr moved to table this Ordinance to the next available time possible <br />for the Council's consideration and Ms. Kissler seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Craddock introduced a public hearing and consideration of an Ordin- <br />ance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING A NEW CHAPTER 35, COMPREHEN- <br />SIVE DEVELOPMENT CODE, TO BE ADDED TO THE CODE OF <br />ORDINANCES OF SAID CITY; PROVIDING FOR THE FORMATION <br />OF PLANNED DEVELOPMENT DISTRICTS (PDD's) IN SAID CITY; <br />ESTABLISHING STANDARDS AND CRITERIA; PROVIDING FOR BUF- <br />FERYARDS; ESTABLISHING PROCEDURES; PROVIDING FOR GEN- <br />ERAL BENEFIT FEATURES; SETTING FORTH BONUS PROVISIONS; <br />PROVIDING FOR CONFLICT WITH OTHER ORDINANCES; PROVIDING <br />FOR SEVERABILITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to the Ordinance. No one did, so Mayor <br />Craddock closed the public hearing. Mr. Robbins reviewed comments con- <br />tained on Page 4 of the memorandum which also reviewed the SMRC Ordin- <br />ance, which is attached to these minutes. Mr. Farr moved to approve <br />the Ordinance on first reading and Ms. Kissler seconded the motion. <br />Mr. Farr said he wanted the maintenance plan submitted for all buffer- <br />yards in the platting process, with bufferyards as easements. Mr. Gonza- <br />lez stated an option could be through dedication. Mr. Farr said he pre- <br />fers the matter to be handled by a deed restriction and be commonly main- <br />taine~with the platted lots or easements with the association addressing <br />the maintenance plan. Gary Winek, owner of the pro- <br />perty, was present to request the zoning change. No one else wished to <br />speak in favor or in opposition, so Mayor Craddock closed the public <br />hearing.
