SECTION 8. That Section E(4) (b) of Article V of Appendix C of the Code of Ordinances, City of San Marcos, Texas, is here- by amended to read as follows: Section E(4)(b) b. A final plat of an approved subdivision master plan or preliminary plan shall be submitted to the Planning Commission in accordance with Article V, Section E. Otherwise the approval of the Planning Commission shall become null and void, unless an extension of time is applied for and granted by the commission as authorized by Sec- tion D, subsection 5 of this Article. SECTION 9. That Section E (5) (b) (7) (a) of Article V of Appendix C of the Code of Ordinances, City of San Marcos, Texas is hereby amended to read as follows: Section E(5) (b) (7) (a) (a) Performance bond. Has filed with the Planning Commission a bond executed by a surety company holding a license to do business in the State of Texas, and acceptable to the City, on the form provided by the City, in an amount equal to the cost of the improvements required by this ordinance, and within the time for comple- tion of the improvements as estimated by the Director of Public Works. The performance bond shall be approved as to form and legality by the City Attorney. SECTION 10. That Section E(5) (b) (7) (c) of Article V of Appendix C of the Code of Ordinances, City of San Marcos, Texas, is hereby amended to read as follows: Section E (5) (b) (7) (c) (c) Unconditional guarantee from local bank or local federally insured savings and loan association or other financial institution as approved by City of San Marcos. Has filed with the Planning Commission a letter on the form provided by the City, signed by a principal officer of a local bank or local federally insured savings and loan associa- tion or other financial institution, acceptable to the City, agreeing to pay to the City of San Marcos, on demand, a sum of money equal to one hundred twenty-five (125) per cent of the estimated costs of installation of all improvements required by this Ordinance, and to be applied to installing said improvements for which the subdivider or developer is responsible under this Ordinance. The guaranteed payment sum shall be estimated costs and schedu- ling as prepared by the Director of Public Works. The letter shall state the name of the subdivision and shall list the improvements for which the subdivider or developer is required to provide. SECTION 11. That Section E(5) (b) (8) of Article V of Appendix C of the Code of Ordinances, City of San Marcos, Texas, is hereby amended to read as follows: -4-
