<br /> -2- <br /> retained amount is to be paid to Contractor by City upon <br /> Contractor's satisfactory completion of this contract. In the <br /> event that City initiates contract termination based on a <br /> violation of this agreement by Contractor; then, Contractor <br /> shall not be entitled to any portion of the amount retained. <br /> Instead, said retained amount will be forfeited to the City. <br /> Otherwise, Contractor shall be entitled to the return by the <br /> City of a pro rata share of said retained amount computed on the <br /> ratio that the number of months satisfactorily completed bear to <br /> the total number of months included in the entire term of the <br /> contract. <br /> IV. <br /> Pursuant to this agreement, Contractor agrees to act as <br /> Cemetery Caretaker and to perform the duties of same pursuant to <br /> the rules and regulations established for the operation of the <br /> Cemetery, said duties to include the plotting and identifying of <br /> gravesites. Contractor shall be responsible for making the <br /> Cemetery available to the public pursuant to the established <br /> rules and regulations of the Cemetery. <br /> V. <br /> During the term of this agreement, Contractor agrees to <br /> provide normal and daily maintenance of the Cemetery. Said <br /> maintenance shall include, and not be 1 imi ted to, services <br /> mentioned in Articles VI, VII, and VI I I. <br /> VI. <br /> GENERAL CARETAKER SERVICES <br /> Contractor shall provide all labor, materials, equipment <br /> and supplies to provide general cemetery services, assist <br /> funeral homes and gravesite contractors prior to graveside <br /> services and complete cleanup after services. <br /> A. Opening and Closing of Cemetery-- Cemetery gates are <br /> to be opened at 8:00 a.m. and locked at 8:00 p.m. each <br /> day during daylight savings time. They shall be <br /> opened at 8:00 a.m. and locked at 6:00 p.m. central <br /> standard time each day. This service shall be <br /> performed seven (7) days per week. At closing time <br /> Contractor shall tour the grounds to ensure that all <br /> citizens are out before locking. <br /> B. Caretaker Service-- Contractor shall have at least one <br /> full-time employee on site from 8:00 a.m. to 5:00 p.m. <br /> from Monday through Friday each week. The employee <br /> shall be trained to locate gravesites within two (2) <br /> weeks of award of contract. <br />
