Because so many calls are anonymous, <br />the police officers can't talk to the person who made the calls. Officers <br />are confined by the law about reasonable amount of noise. Mr. Guerrero <br />inquired to the Police Department's definition of reasonable. Chief <br />Williams stated what is reasonable on noon on Saturday may not be <br />reasonable at midnight on Saturday night. He also stated the officers have <br />to consider the noise for the conditions and the circumstances. Mr. Bose <br />inquired to why residents are calling in anonymous. Chief Williams stated <br />usually because the individuals are worried about retaliation. Mr. Jones <br />inquired to the common factor in the Sagewood situation. Chief Williams <br />stated most of the time alcohol is involved. Mr. Jones inquired to whether <br />there are problems in the other multi- family zoned areas in San Marcos. <br />Chief Williams stated these types of issues exist all over town. Mr. Jones <br />inquired to why the tactics are not working. Chief Williams stated he <br />feels the reason the tactics are not working is because of the criminal <br />violations and feels the arrests are the way to go. He stated some of the <br />other issues work with peer pressure. Mr. Jones stated San Marcos is not <br />the only university city with these issues. He inquired to what the other <br />Municipalities are doing about these problems. Chief Williams stated he <br />has spoken with other communities and he feels the problems in San Marcos <br />are because our community has a huge population of students. He stated <br />most the other Municipalities have pockets of student housing. Mayor <br />Narvaiz inquired to whether a party noise call is made before a certain <br />time; does it get the same results of a noise call that is later in the <br />night. Chief Williams stated the issues are the time of night or early <br />morning and the level of noise. Mayor Narvaiz stated she feels with the <br />number of noise complaints on noise it sounds like a lot of work to write <br />citations, since only loo are held accountable. Chief Williams stated 1 <br />in 6 loud noise calls will receive a written citation. Mr. Bose stated he <br />feels the consequences for this behavior are not severe enough to change <br />the behavior. He also stated he feels rules need to be followed with <br />consequences given immediately and need to have rules for the property <br />owners. Chief Williams stated currently the Police Department can only <br />write citations when they commit other violations. Mayor Narvaiz stated she <br />feels the Council should consider putting into place laws that can help <br />with these situations. Mr. Jones stated he feels the City has a different <br />situation on Sagewood. He stated these residents don't maintain the same <br />hours as residents with families or jobs. Mayor Narvaiz stated she does <br />not feel there has been much enforcement. Mr. Thomaides stated he feels <br />this issue is not only in multi - family areas. He stated he receives phone <br />calls every year when there is a student turn around. He stated these <br />problems were discussed at the University Conference he attended. He <br />stated he feels the City should partnership with the University and also <br />consider permitting rental properties. He also suggested having an off <br />campus code of conduct, with a Judicial Review Board. Mayor Narvaiz stated <br />she has spoken to Dr. Trauth regarding these issues.
