<br />13 <br /> <br />Regular Meeting <br /> <br />January 9, 1989 <br /> <br />Page 3 <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING CHAPTER 31, MUNICIPAL AIRPORT, OF THE SAN <br />MARCOS CODE OF ORDINANCES, TO PROVIDE NEW AIRFIELD <br />COMMUNICATIONS INFORMATION AND TRAFFIC PATTERN DIRECTIONS <br />AND REPEALING A $30.00 PER MONTH FEE FOR TIE-DOWN AIRCRAFT <br />LEASED AT THE AIRPORT AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading <br />and Ms. Kissler seconded the motion. Jack Doughty advised the <br />City Council the Airport Commission was recommending the waiving <br />of the tie-down monthly charge of $30.00 for a one-year period to <br />see if it would help increase planes at the airport. Mr. Doughty <br />stated the City would still have the planes on the tax roll and <br />that the planes would probably buy most of their fuel and have <br />maintenance performed at our airport. He stated part of FAA <br />grant evaluations review the plane population at the airport. <br />There has been a decrease in planes and the Commission is trying <br />to find a way to increase airport activity. Mr. Doughty advised <br />the Council tie-down charges of some of the area airports are as <br />follows: Austin - $65.00; Georgetown - $25.00; Lockhart - $15.00 <br />and New Braunfels - No Charge. Mr. Brown moved to amend the <br />Ordinance to reflect the repeal of the tie-down charge for the <br />calendar year 1989 (to be made retroactive to January 1, 1989) <br />and Mayor Morris seconded the motion, which passed unanimously. <br />The Council then voted unanimously for approval of the Ordinance <br />on first reading. <br /> <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on second reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ADDING TO THE SAN MARCOS CODE OF ORDINANCES, CHAPTER <br />16, MISCELLANEOUS OFFENSES AND PROVISIONS, ARTICLE I, A NEW <br />SECTION 16-13 TO PROHIBIT JUMPING AND DIVING INTO THE SAN <br />MARCOS RIVER WITHIN 50 FEET OF THE SPRINGLAKE DAM, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Brown moved for approval of the Ordinance on second reading <br />and Mr. Moore seconded the motion. Philip Hicks, opposing the <br />adoption of the Ordinance, stated such adoption would set a <br />precedence for the City to assume liability of property owners. <br />Kyle Kimbrough stated he supports Mr. Hicks' views. He stated <br />some compromise needs to be reached and that enforcement of this <br />Ordinance would be difficult. Mr. Hankins stated complaints can <br />be filed by citizens as well as being enforced by police <br />officers. Mayor Morris stated she is not sure this matter is the <br />City's business and moved to table consideration of the Ordinance <br />and Mr. Guerra seconded the motion. On roll call the following <br />vote was recorded: <br /> <br />AYE: Hernandez, <br />NAY: Moore. <br />ABSTAIN: None. <br /> <br />Brown, Morris, Guerra, Kissler, Plummer. <br /> <br />Mayor Morris introduced for consideration a discussion and <br />adoption of a Resolution regarding tax abatement. Mr. Gilley <br />stated the purpose of tax abatement is to allow incentives for <br />growth of the City. The City must adopt a policy of criteria how <br />individuals or businesses will go through the process. The <br />policy must be in place to allow tax abatement, and Mr. Gilley <br />could provide a policy to the Council at the January 23 meeting. <br />
