Mr. Quittner asked the Council to take this item up after Item 36, so he <br />can get a copy of the City Charter. <br />Mayor Narvaiz introduced a public hearing and consideration adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM INDUSTRIAL TO <br />COMMERCIAL FOR A 29.42 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED <br />AT 4500 IH -35 SOUTH; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "LI" LIGHT INDUSTRIAL DISTRICT TO "HC" HEAVY <br />COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Ms. <br />Robertson moved for adoption of the Ordinance, and Mr. Guerrero seconded <br />the motion, which passed unanimously. <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CIT <br />AMENDING THE ORDINANCE ADOPTED ON AUGUST 6, <br />AND SPECIAL ELECTION TO BE HELD ON NOVEMBER <br />HOURS AND PLACES WHERE EARLY VOTING WILL BE <br />SECTION 3 TO CORRECT A TYPOGRAPHICAL ERROR; <br />EMERGENCY. <br />Y OF SAN MARCOS, TEXAS, <br />2007, ORDERING A GENERAL <br />6, 2007, BY INCREASING THE <br />AVAILABLE, AND AMENDING <br />AND DECLARING AN <br />Mr. Jones moved for adoption of the Ordinance on emergency with amendment, <br />and Mr. Guerrero seconded the motion. Mr. Quittner stated he provided a <br />proposed amendment for the Proposition, which would provide a clearer <br />understanding of the project to the voters. He also stated the statue <br />provides the language and the City needs to correct an error. Ms. Goodwin <br />stated the Ordinance was originally amended, because other entities sharing <br />the ballot had amended their times and dates for Early Voting. The Council <br />then voted unanimously for adoption of the Ordinance. <br />Mayor Narvaiz introduced consideration approval of an Annexation Ordinance <br />on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 212.556 ACRES, MORE OR <br />LESS, LOCATED NORTHWEST OF CITY LIMITS OFF LIME KILN ROAD (WINDEMERE <br />RANCH); APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />
