Mr. Jones moved for approval of Annexation Ordinance on first reading with <br />amendment, and Mr. Guerrero seconded the motion, which passed unanimously. <br />Mayor Narvaiz introduced consideration approval of an Annexation Ordinance l. <br />on first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 5.816 ACRES, MORE OR <br />LESS, LOCATED IN THE 1800 BLOCK OF POST ROAD (POST ROAD VILLAS); <br />APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br />Mr. Guerrero moved for approval of Ordinance on first reading, and Ms. <br />Couch seconded the motion. Mr. Bose inquired to whether the road would <br />become a City road. Mr. O'Leary stated this road would become a City road. <br />Ms. Anderson stated the road would need to be built to the City <br />specifications. The Council then voted unanimously for approval of <br />Ordinance on first reading. <br />Mayor Narvaiz introduced consideration approval of Ordinance on first <br />reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ARTICLE 4, STOPPING, STANDING PARKING, OF CHAPTER 82, TRAFFI <br />AND VEHICLES, OF THE SAN MARCOS CITY CODE, TO DECLARE THE VIOLATION 0 <br />A PARKING OR STOPPING ORDINANCE TO BE A CIVIL OFFENSE, PROVIDE AN <br />ADMINISTRATIVE HEARING PROCEDURE, APPOINT HEARING OFFICERS, ADD <br />ENFORCEMENT PROCEDURES; AND INCLUDING PROCEDURAL PROVISIONS. <br />Ms. Couch moved for approval of Ordinance on first reading, and Mr. <br />Thomaides seconded the motion. Mr. Jones inquired to why the City is doing <br />this. Mr. Quittner stated by changing some charges to civil, it reduces <br />the burden of proof. He stated currently parking tickets are written to <br />the car owner and in criminal cases these can be dismissed if the owner <br />shows they were not there. He stated in civil court, it would be the <br />ticket holder. Mr. Thomaides inquired to whether fines could be lowered or <br />raised. Mr. Quittner stated the fines can be lower because a portion of <br />criminal fines are sent to the State. He stated since they are not being <br />changed to civil fines they can be lowered or raised.
