Regular Meeting April 3, 2007 Page 6 <br />"FD" FUTURE DEVELOPMENT, TO "MU" MIXED USE DISTRICT, INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />O'Leary stated this is a subdivision concept plan, based upon a mix of low <br />density residential uses assigned variously across the development. The <br />first sections of the 2,000 plus unit subdivision is platted, <br />infrastructure built and accepted, with model homes under construction. He <br />stated the applicant, Carma Texas, has asked for more flexibility in <br />development of the project than what is accommodated by discrete zoning <br />categories. The developers plan to continue developing the site with low <br />density residential, limited commercial, and public uses but will now be <br />afforded the ability to shift densities and locations of differing housing <br />products within the subdivisions boundaries. Mr. O'Leary stated any <br />deviation from the concept plan will require an amendment to the concept <br />plan be granted by the Planning and Zoning Commission before any <br />development outside of the original parameters is allowed. He stated the <br />Planning and Zoning Commission approved this request 7 -0. Ms. Robertson <br />stated she has concerns with these lots being a Mixed Use heading and the <br />plat heading reads Single Family. Carol Barrett, Director of Planning and <br />Development, stated the Planning and Zoning Commission approved this <br />request with conditions of nine changes that will need to be made. Ms. <br />Robertson stated with the entire plat being zoned Mixed Use it allows <br />residential and commercial. Ms. Barrett stated a plat note would be made <br />restricting use of houses to residential uses. Mr. O'Leary stated Mixed Use <br />allows both residential and commercial, but the plat will be specified. <br />Ms. Barrett stated the plat does identify certain areas as residential and <br />some as commercial. The Council then voted unanimously for adoption of the <br />Zoning Ordinance. <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY'S 2006 -2007 CAPITAL IMPROVEMENT PLAN BUDGET TO ADD <br />THE CONFERENCE CENTER AS A LINE ITEM, TO FUND THE CONFERENCE CENTER <br />BUDGET WITH THE PROCEEDS FROM THE JANUARY 2007 SALE OF GENERAL <br />OBLIGATION BONDS; AND DECLARING AN EMERGENCY. <br />Mr. Guerrero moved for adoption of the Ordinance on emergency, and Mr. <br />Jones seconded the motion. Mr. O'Leary stated this Ordinance is a <br />housekeeping Ordinance to add a line item for the Conference Center. The <br />Council then voted unanimously for adoption of the Ordinance on emergency. <br />Mayor Narvaiz introduced for consideration the reconsideration of adoption <br />of a Zoning Ordinance. The Council choice not to reconsider the Zoning <br />Ordinance, the caption reads as follows: <br />
