<br />I <br /> <br />I <br /> <br />SECTION J. Parks and Playgrounds <br /> <br />Consideration shall be given to the dedication of suitable sites for parks <br />and playgrounds. The actual provision of such areas shall be governed by <br />the following provisions: <br /> <br />1. <br /> <br />Subdivisions of Less Than Twenty (20) Acres. In a subdivision of less <br />than twenty (20) acres, no park requirement shall be made unless, at <br />the time of the filing of the preliminary plat, the City has developed, <br />or coincidentally with the development of said subdivision will develop, <br />a park within a distance of one-quarter (1/4) mile of the closest lot <br />line of the most distant lot in the tract proposed to be subdivided, <br />in which event the subdivider shall be required to deposit in the <br />City's Park Development Fund, money equivalent to the ~aw land value <br />of five (5) percent of the area within the subdivision for the devel- <br />opment of the closest park to the subdivision. <br /> <br />2. Subdivisions Greater Than Twenty (20) Acres. In a subdivision of <br />twenty (20) acres or more, the subdivider shall be required to dedicate <br />five (5) percent of the total area of the subdivision for park pur- <br />poses at a location to be approved by the Commission and under the <br />following provisions and conditions; <br /> <br />a. The area of the park to be dedicated shall be measured and cal- <br />culated to the centerline of any street within the subdivision <br />bounding said park. <br /> <br />b. When a subdivision is to be developed in stages or by units so <br />that the actual platting of the park area to be dedicated in con- <br />nection with said subdivision will be deferred until the second <br />or a later unit, the subdivider shall complete and deliver to the <br />Commission, with the final plat of the first unit of said subdi- <br />vision, an agreement form furnished by the Commission which shall <br />provide for the future dedication of such park. <br /> <br />c. <br /> <br />The City shall bear its portion of the cost of curb and gutter <br />and paving on any streets within the subdivision bounding the <br />park being dedicated, and shall also pay the cost of any utility <br />extensions required to serve the park. Any agreements made by <br />anyone or any entity to dedicate to the public any park area or <br />areas prior to the effective date of this Ordinance, shall never <br />be construed as coming within the provisions of this section in <br />obligating or committing the City to pay any portion or part of <br />the costs of curbing, gutters, and paving of any streets that <br />bound such park area. <br /> <br />d. The City shall improve the dedicated park area coincidentally <br />with the development of the subdivision. By the term "improve" <br />as used in this portion of the Ordinance, is meant such filling <br />and grading as may be necessary for the practical use of said <br />park, together with the installation of an irrigation system, <br />sodding, and planting of basic trees and shrubs. <br /> <br />-42- <br />
