<br />e. <br /> <br />In the event the City should not be able to provide the develop- <br />ment as outlined above, the subdivider shall have the option to <br />improve the dedicated park area, as the word improve is defined <br />in this portion of the Ordinance, under a contract between the <br />City and the subdivider, providing for repayment by the City to <br />the subdivider for the cost of such improvements within the <br />following eighteen (18) months from the date of completion thereof, <br />and at an interest rate on the unpaid balance equal to the prime <br />rate; provided that such development shall be done under the <br />supervision of Parks and Recreation and according to the City <br />plans. <br /> <br />I <br /> <br />f. <br /> <br />Dedicated park areas shall be a minimum of one a~re, provided how- <br />ever, that for subdivisions over twenty (20) acres, one or more <br />park areas may be dedicated, subject to approval of the Commission. <br /> <br />3. Replat Exception. The foregoing paragraphs 1 and 2 shall not apply in <br />the case of a replat of a plat, subdivision, or addition that has <br />previously met park requirements, or the redivision of existing single <br />lots. <br /> <br />4. Zoning Exception. Notwithstanding any of the other provlslons of this <br />Ordinance, it is not intended that any area be required to be dedicated <br />for park purposes when the land embraced in the plat is an area which <br />is zoned under existing Zoning Ordinance of San Marcos for commercial <br />or industrial purposes. <br /> <br />SECTION K. Natural Tree and Ground Cover <br /> <br />Natural tree and ground cover shall be preserved whenever possible. Other <br />landscape features shall be carefully protected from abuse, marring, or <br />damage during construction. <br /> <br />ARTICLE VII <br />RESPONSIBILITY FOR PAYMENT OF INSTALLATION COST <br /> <br />I <br /> <br />SECTION A. Street Construction <br /> <br />1. Internal Streets <br /> <br />a. The subdivider shall be responsible, at his own expense, for the <br />construction of all streets within his subdivision. <br /> <br />b. The subdivider shall, at his own cost, dedicate such right-of-way <br />for streets and construct such streets of such a size as required <br />in Article VI, Section B herein so as to adequately serve the <br />area being subdivided; however, if the City should require dedi- <br />cation of additional rights-of-way or the construction of streets <br />of a size or quality greater than set out above, the City shall <br />within one (1) year after date of approval of the final construc- <br />tion plans, provided construction has been completed within such <br />one year period and in accordance with approved construction <br />plans, reimburse the subdivider for any increased cost of such <br />facilities. <br /> <br />-43- <br /> <br />~ <br />
