Such fee shall be paid by the applicant <br />and shall not be designed for restricting an applicant's ability <br />to seek a hearing and/or generate revenue for other than recovery <br />of actual administrative cost incurred by the City. <br /> <br />G. Applications for Zoning Change: <br /> <br />1. Applications for a zoning change shall be made on forms <br />provided by the City. <br /> <br />2. The same zoning request shall not be considered on any <br />parcel more than once in any twelve-month (12) period of <br />time unless the Planning and Zoning Commission, by a 3/4 <br />vote of members present, determines that there has been a <br />substantial change in conditions surrounding the subject <br />land since the prior request, and agrees to reconsider the <br />request. <br /> <br />3. The staff shall review all zoning requests, and provide the <br />Planning and Zoning Commission with their concerns and com- <br />ments, and make sure that the Commission has sufficient in- <br />formation to make a recommendation. <br /> <br />SECTION 3 - OFFICIAL ZONING MAP <br /> <br />The Official Zoning Map of the City of San Marcos shall be kept in the <br />official files of the City Secretary. Certified copies shall be maintained <br />in the office of the City Manager, the Director of Planning, the official <br />files of the Planning and Zoning Commission, the Chief Inspector, the City <br />Engineer and the office of the Tax Assessor-Collector. The Map entitled <br />ZONING MAP OF THE CITY OF SAN MARCOS, TEXAS, shall constitute an official <br />part of this Ordinance as hereinafter set out. <br /> <br />The boundaries of the districts referred to in this ordinance are indicated <br />upon the Zoning Map of the City which is adopted with and declared to be a <br />part of this Chapter (Appendix). All notations, references, and other <br />information shown upon said zoning map is hereby made a part of this ordinance, <br />and shall be considered as much a part of the same as if the matters of <br />information set forth thereby were all fully contained and described herein. <br />Such map shall, on the face, be identified and verified in the following <br />manner: It shall bear the title "Z0NING MAP OF THE CITY OF SAN MARCOS, <br />TEXAS", and shall bear the names of the Governing Body, the City Manager, <br />and the Chairman of the Planning and Zoning Commission and the date of its <br />adoption. It shall bear the signature of the Mayor, attested by the City <br />Secretary, and the Official Seal of the City affixed thereto. Changes and <br />amendments shall be properly noted and dated. A replica thereof shall be <br />produced upon paper in such reduced scale as to permit said replica being <br />attached to the transcription of this ordinance. <br /> <br />SECTION 4 - DEFINITIONS <br /> <br />For the purpose of clarification, it is the intent of this Ordinance <br />that the following words or phrases shall be interpreted to have the mean- <br />ing as outlined below: <br /> <br />I. Accessory Building: In a residential district, a subordinate <br />building, attached to or detached from the main building, without <br />separate utilities, and not used for commercial purpose, or <br />rented. It may be used as servants' quarters, a washroom, storage <br />room for domestic storage belonging to the owner or tenant only, <br />or a space for one or more automobiles owned by the owner, tenant <br />or guests. In districts other than residential, an accessory <br />building is a subordinate building the use of which is incidental <br />to and used only in conjunction with the main building. <br /> <br />2. Accessory use: A use customarily incidental and subordinate to <br />the main use; provided further, that a use is an accessory use in <br />a "Residential" district only if the use is located on the same <br />lot as the main use. <br /> <br />-3- <br />
