Mr. Thomaides moved <br />to appoint of Moe Johnson, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration approval of one appointment to <br />the Convention and Visitors Bureau to complete a vacancy. Mr. Guerrero <br />moved to appoint of John Diaz as the Council Member representative, which <br />passed unanimously. <br /> <br />II <br /> <br />Mayor Narvaiz introduced for consideration approval of one appointment to <br />the San Marcos Industrial Development Corporation to complete a vacancy. <br />Mayor Narvaiz moved to appoint Mike Davis, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2005-2006 CITY BUDGET TO PROVIDE FUNDING FOR ACQUISITION <br />OF A TRACT OF PROPERTY FOR PARKLAND; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency, and Mr. <br />Jones seconded the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration removal from the table and <br />approval of an Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO AMEND THE PURPOSES, <br />POLICIES, REGULATIONS AND PROCEDURES OF THE CITY'S CODE OF ETHICS; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved to remove the Resolution from the table and Mr. <br />Guerrero seconded the motion, which passed unanimously. Mr. Mihalkanin <br />moved for approval of the Ordinance on first reading, and Mr. Guerrero <br />seconded the motion. Mr. Mihalkanin inquired as to Division 3, Finance <br />Disclosure regarding loan information. Mr. Taylor stated loan information <br />for Council and appointees are reportable each year. Mr. Thomaides stated <br />he feels Disclosure Statements need to be more explanatory. Mr. Jones <br />inquired as to the need for amendments to the Ordinance. Mr. Taylor stated <br />these amendments are modeled after other municipalities in Texas and <br />because there are changes in the law, which lead to the rewrite of the <br />Ordinance. Mr. Thomaides stated he is concerned with the wording in <br />Section 2.444. Mr. Mihalkanin stated he is concerned with the Ethics <br />Review Commission making a recommendation to recall a Council Member. He I <br />stated he feels the voters put members into office and only the voters can <br />recall a Council Member. Mr. Taylor stated the Ethics Review Commission <br />
