<br />216. <br />Regular Meeting <br /> <br />March 21, 2006 <br /> <br />Page 6 <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption of <br />an Ordinance, the caption which was read as follows: I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE FUTURE LAND USE MAP OF THE MASTER PLAN OF THE CITY, FROM <br />INDUSTRIAL TO COMMERCIAL FOR A 30 ACRE, MORE OR LESS, TRACT OF <br />PROPERTY LOCATED IN THE 1300-1400 BLOCKS OF CENTERPOINT ROAD; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Diaz <br />moved for adoption of the Ordinance, and Mr. Guerrero seconded the motion. <br />Mr. Jones inquired as to this property being changed from Industrial to <br />Commercial. Carol Barrett, Director of Planning and Development, stated <br />the applicants are proposing the land use map for the property to include <br />approximately 20.65 acres as an RV park and a one-acre portion as a King 9 <br />Hotel with the remaining 8.52 acres used for a cul-de-sac, which is allowed <br />in commercial zoning. Mr. Mihalkanin stated this is the second property <br />recently being changed from Industrial to Commercial. The Council then <br />voted unanimously for adoption of the Ordinance. <br /> <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 34, ENVIRONMENT, OF THE CITY OF SAN MARCOS CODE OF <br />ORDINANCES TO ADD NEW SECTIONS TO ARTICLE 5, AIR POLLUTION, <br />PROHIBITING CERTAIN MOTOR VEHICLE IDLING; PROVIDING FOR PENALTIES; AND <br />DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency, and Mr. <br />Guerrero seconded the motion. Mr. O'Leary stated in July, 2005, the <br />Council approved a Resolution to support inclusion of a rule in the Early <br />Action Compact that prohibits idling of heavy duty motor vehicles. He <br />stated this Ordinance will prohibit large vehicles of 14,000 pounds and <br />larger from idling in the City for more than 5 minutes. Mr. Diaz inquired <br />how this Ordinance will be enforced. Mr. O'Leary stated this will be a <br />ticketed offense by the Police Department. Mr. Taylor stated the fine can <br />be up to $500.00 per offense. Mr. Diaz inquired as to the diesel engines <br />which need to run for a certain period of time. Bill Gill, Capital Area <br />Council of Governments, stated there are 10 or 12 different exemptions <br />built into this rule. The Council then voted unanimously for adoption of <br />the Ordinance on emergency. <br /> <br />Mayor Narvaiz introduced a discussion regarding the status of I <br />illustrations/display boards shown to the Planning and Zoning Commission <br />and City Council during consideration of development applications.
