Sec. 3.09, Meeting of the City Council, should be amended by the following addition at the end of the present section (a copy of Sec. 3.09 is attached as Appendix B): "The City Council shall provide by ordinance for procedures to call meetings, set meeting agendas, conduct meetings, provide for reasonable time limits on presentations to the Council and any other matters necessary to the efficient and fair conduct of the public's business." JUSTIFICATION: There is at present a City ordinance which accomplishes some of the purposes found in the amendment written above. However, such additions as those suggested in the amendment will contribute to greater efficiency and fairness in the Council's connuct of business. 9. JUSTIFICATION: The Municipal Code Corporation which publishes the Charter and the Code of Ordinances for the City of San Marcos does recodifications approximately every six months as new ordinances or charter revisions are received from the City Secretary. As a result of this practice, the Charter and the Code of Ordinances are kept constantly updated. This provision, then, is obsolete and should be deleted for that reason. 10. Section 4.03, Corporation Court, should be revised by deleting subsection (b), (c), (d), and (e) and adding the following new subsections (b) and (c) (a copy of Sec. 4.03 is attached as Appendix D): (b) "Appointment of a presiding judge and any associate shall be determined by City ordinance and State law. judges (c) Appointment of a Municipal Court Clerk and assistants be rletermined by City ordinance and State law." shall JUSTIFICATION: The change to a Municipal Court of Record necessitates complying with State law for the selection of the Municipal Court Judge and the Municipal Court Clerk and their assistants. Therefore, since State law controls the actions of the City with regard to these -matters, no provisions more detailed than those suggested need to be in the City Charter.
