<br />101 <br /> <br />Regular Meeting <br /> <br />February 8, 1988 <br /> <br />Page 7 <br /> <br />Mayor Younger introduced Item 15 on the Agenda, adoption of an Ordin- <br />ance on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ORDERING A SPECIAL AND A JOINT GENERAL <br />ELECTION BY SAID CITY AND THE SAN MARCOS CONSOLIDATED <br />INDEPENDENT SCHOOL DISTRICT TO BE HELD IN THE CITY OF <br />SAN MARCOS, TEXAS ON MAY 7, 1988 FOR THE PURPOSE OF <br />ELECTING A MAYOR, A CITY COUNCIL MEMBER, PLACE FIVE, <br />AND A CITY COUNCIL MEMBER, PLACE SIX, SUBMITTING TO <br />THE VOTERS PROPOSED AMENDMENTS TO THE CHARTER OF SAID <br />CITY" A PROPOSITION FOR OR AGAINST SINGLE-MEMBER DIS- <br />TRICTS FOR THE ELECTION AND SERVICE OF CITY COUNCIL <br />MEMBERS, A PROPOSITION REGARDING THE TYPE OF SINGLE- <br />MEMBER DISTRICT SYSTEM IF SAID CITY ADOPTS A SINGLE- <br />MEMBER DISTRICT PLAN, A PROPOSITION REGARDING THE <br />METHOD OF SELECTION OF THE JUDGE OF THE MUNICIPAL <br />COURT OF RECO~D OF SAID CITY, A PROPOSITION REGARDING <br />THE REMOVAL OF A PARKLAND RESTRICTION ON CERTAIN CITY <br />PROPERTY AND A PROPOSITION CONCERNING A STREET ASSESS- <br />MENT PROGRAM; SAID JOINT GENERAL ELECTION TO BE HELD <br />WITHIN AND WITHOUT THE CORPORATE LIMITS OF SAID CITY <br />FOR THE PURPOSE OF ELECTING A SCHOOL DISTRICT BOARD OF <br />TRUSTEES MEMBER, PLACE ONE, AND A SCHOOL DISTRICT BOARD <br />OF TRUSTEES MEMBER, PLACE TWO; ESTABLISHING THE RATE OF <br />COMPENSATION TO BE PAID JUDGES, CLERKS AND ASSISTANTS <br />TO THE TABULATION SUPERVISOR FOR SERVICES RENDERED DUR- <br />ING SAID ELECTION; MAKING PROVISIONS FOR THE CONDUCT <br />OF THE ELECTION AND OTHER PROVISIONS INCIDENT TO THE <br />PURPOSES OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Guerra moved for adoption of the Ordinance on emergency and Mr. <br />Hernandez seconded the motion. Mr. Guerra moved to amend the Ordin- <br />ance to add r'Proposition No. 20. The returns of every municipal elec- <br />tion shall be delivered by the election judges to the city secretary <br />not later than twelve (l2) hours after the closing of the polls. Re- <br />turns of the elections, general and special, shall be presented to the <br />city council on any date permitted by the Texas Election Code, at which <br />time the council shall canvass and declare the results of such elec- <br />tion," [Ordinance wording for ballot: FOR/AGAINST Amend Section 5.07 <br />of the City Charter to require that canvassing of election returns be <br />conducted at times permitted by the Texas Election Code] and Mr. <br />Brown seconded the motion. On roll call the following vote was re- <br />corded: <br /> <br />AYE: <br /> <br />Brown, Guerra, Younger, Hernandez. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Nicola. <br /> <br />(Mr. Farr not present to vote on this item - 9:00 p.m. and did not <br />return to the meeting until lO:15 p.m.). <br /> <br />Mr. Guerra moved to amend the Ordinance to renumber all non-binding <br />referendums and group them together at the end of the propositions <br />to be numbered 2l, 22 and 24 and Mayor Younger seconded the motion, <br />which passed unanimously. Mayor Younger moved to amend the Ordinance <br />to number Section 5.07 as Proposition 21 and to renumber the proposi- <br />tions Qn Page 4, and Mr. Guerra seconded the motion, which passed <br />unanimously. Henry Kyle advised the Council he was opposed to the <br />
